    Immihelp,
    My wife came to the US from India as a derivative asylee on her father's case. She applied for AOS in July 2003, and still waiting for the approval.

    She doesn't need EAD to work legally, because asylees are no more required to have it in order to work.

    She has not been to India since she came about 4 years ago. She wants to visit India this year, and anxiously waiting for her GC to come through, without which it might be difficult for her to come back to the US, if she leaves without one. She has heard stories how Immigration Officials in India harass people who left the country as asylee, and came back without GC. The similar stories at the POE in the US, when asylees visit their country of persecution.

    I am on L1A (Multinational Manager) and we got married in Dec 2004, and I am eligible to file I-485 as L1A-C in June 2006(Priority Date Dec 2005). I am hoping, I could include her in my I-485 application, after which she can get EAD and Advance Parole.

    My questions are for the period between now and until she gets her GC either through me or her father's case:

    1) Which status will she be on, after applying I-485 through my case, Asylee or L2A?
    2) Does she "have" to use the EAD received through my case, or she can still keep working as asylee(which means no EAD required)?
    3) Can she travel to India with no problem on the AP received through my case?
    4) After she uses EAD, AP applied through my case, does she lose the ability to work as an asylee?
    5) Can she use her medical exam results which she had done in Dec 2005 for the new I-485, which we are going to apply in June 2006. I believe the results are valid for 12 months.
    6) Should I really apply for her EAD?

    Probably not answering your question but can't help but wondering..........if she is an asylee and whatever the circumstances, they were so bad that her family had too flee to protect their lives, why does she need so desperately to visit her country of persecution so quickly.....its only 4 years!!!!!!
