  • Priority date

I was wondering how important is the priority date in regard of the timing to obtain the EAD and GC?

For example, what is the difference to have the priority date in October 2017 or November 2017 when you file in November 2017?

    Thanks.

For any particular adjudicating office, EAD/AP timeline is a function of when Form I-485 was filed in complete form (ie no RFE, or when all RFE's are satisfied). So no, it has nothing to do with priority date

Ok, I see! Why priority date is important then? Let say John has a priority date 11/1 and submit I-485 on 11/10. Pete has a priority date 10/1 and I submit I-485 on 11/20. Which one will get green card first assuming that both submitted all documents correctly.

Thanks for the replies. I just want to understand how the system works and I can address those questions to other people as well.

The priority date is important because the applicant for adjustment of status can not file Form I-485 until their priority date is current, which depends on their preference category and country of chargeability.

In your example, John will most likely get his EAD/AP combo card first, because he filed his Form I-485 first. Your example is perhaps a little contrived - If their immigrant petition priority date is so close to their I-485 filing date, it implies that their immigrant petition was current when filed - in which case they could have easily filed both forms concurrently
