    I recently got my GC, but my wife didn't. We were called for an interview and the officer has asked her to submit a "Certificate of no-availability" of the Birth Certificate, since she doesn't have one, from a registrar in India. She had already submitted affidavits from her parents but the officer said these were not enough.

    We enquired with the registrar in India and he said that he is not in a position to write such a letter. We are now in a quandry. Can someone please tell us as to what would be our other option.

    Often times, birth certificates are not a form of identity in other countries. Please keep in mind that USCIS needs birth certificates for the following reasons:

    1. Birth date (of course)
    2. Name verification
    3. Birth place (to match what you filled out on forms and to see if family relation is on basis of a common ground in case of family-based immigration)
    4. Parents' names (for verification and record)

    This document, if in other languages, has to be translated and notarized. Immigration attorneys often do such jobs. If original document becomes lost or is not available, the certificate of no availability requires the office of registrar to make a notarized statement that such document is not available, and possibly, based on the way how they manage population registration, a letter verifying above mentioned four items can be issued as well.
