  • Going ahead with mediocre documents

Hi, is it better to go ahead with not so solid documents and apply before 180 day out of status (f1), or, is it better to get more solid documents and apply a bit late( after more than 180 days)?

Which documents are you concerned about?

Assuming you are petitioned by your US citizen spouse (otherwise you can't AOS when out of status anyway), it makes no difference how long you have been out of status. Even if you applied after years out of status, it would make no difference. However, the sooner you apply the better because you are subject to deportation until you apply.

Not sure what you mean by "mediocre documents". If you mean the evidence of bona fide marriage is not much, you can always bring more evidence by the time of the interview. If you mean you are missing some required document for I-485, like birth certificate, marriage certificate, or something like that, you should wait until you have it to file.

This is my personal opinion and is not to be construed as legal advice.
