  • Becoming Stay-At-Home-Mom While Adjustment of Status Pending

My wife came to the USA 2 years ago on a L1 Visa. We were married a year ago and are still waiting on our adjustment of status to go through for a green card. Adjustment of status is due to the marriage.

My income has gone up quite a bit and we had a child, so she wants to quit her job and become the primary caregiver.

I was told by USCIS that she can quit her job and stay in the country while her I-485 is still pending. Did the person that I spoke with understand this correctly? Any asterisks ?

No. Someone with I-485 pending can stay in the US regardless of whether they have status.

If she didn't apply for an EAD (with I-765) and an Advance Parole (with I-131) it would be a good idea to apply for them. They are free for I-485 applicants.
