  • I130 and i485

    Hi, I am on h1 b and working as fte for last 6 years. My eb2 priority date is April 2011. Due to long waiting time, I am thinking to apply GC through my wife who is us born citizen. My question is should I file on my own or hire attorney ? What are the risks by filing by own ? Other option I was thinking to fill all the forms and have reviewed by some lawyer for nominal fee. Thoughts ?

    We filed by ourselves. I checked those forms about 3 million forms before I sent them! At least doing it yourself means you've been thorough. We didn't find it too difficult; you know all the information and as long as you go through every section you should be good.

    This forum has so much information on too; there are checklists on what to include and people give so much good advice.

    I did call an attorney right at the beginning to ask what you suggested; that we complete the forms and they check it over. His secretary said that he (and others) would not do that and the only way he would accept us is for us to pay a retainer and have him as our attorney throughout.

      Assuming you don't have criminal history or prior violations of immigration regulations, you have a very straightforward case. An attorney will merely complete the forms with the information you provide, and not offer any real value. If I were you, I'd complete the forms yourself

          One Question - My H1 is expiring next month and my employer filed for extension. will that be issue when I file by i130 and i485 ? Do I need to show any proof that I am still on valid status ?

            Because you are adjusting your status to that of a permanent resident based on an "immediate relative" immigrant petition, you merely need to show proof that you were lawfully inspected and admitted to the United States on your most recent entry. Your status since your entry is irrelevant. If tomorrow your H status extension was denied or your employer terminates your employment, you can still apply for permanent residence on the basis of your marriage to a US citizen.

              i130 filing question

              I am filing by i130 and have question on following -- If the beneficiary's native written language does not use roman letters,type or print his or her name and foreign address in their native written language

              My native language is Indian so I will write my name in my native language. For Foreign address, Which address should I enter ?

              Last Place where I live in India or My parent;s address in India

              Note: I am living in states since 2004

                Yes write your name in hindi and yes the last place you lived in India.
