Ok so my package was delivered yesterday to Chicago so I guess my EAD & SSN will be after April 15. My husband wants to claim me on the 2017 tax return but I don't have SSN. We we're thinking of applying for iTIN (which we would get faster within 2 months time) in the mean time while my AOS is "pending". My question is, can I still apply for iTIN even though I sent in the I-765? For those of you that aren't aware, the new and updated I-765 form has options for you to apply for a SSN.

My husband just got his EAD this month. We used the new I 765 form and requested a SSN, but he never received anything from SSA, so he went to the SSA to apply for a SSN. I'm not sure about the ITIN, sorry.

Originally posted by michael.satish View PostIm in the same boat, not sure whether to go ahead and apply for ITIN or wait for SSN, the package was sent on Dec 29, 2017. My assumption is only when EAD is approved, then USCIS will initiate or direct SSN office to issue a SSN. If thats the case, applying for ITIN should not be an issue. Right? in IRS website, it is stated not to apply for INIT if SSN is in progress.

Technically, you could say your SSN is not in progress because your EAD has not been approved yet. I would just go ahead and apply for it. Why not?
'Don’t submit this form if you have, or are eligible to get, a U.S. social security number (SSN).'
Once the EAD is approved you are eligible to get or apply SSN, so I don't think there is an issue if someone wishes to apply for ITIN.
