  • On ESTA - now want to stay

    Hey all

Ive just joined this forum as it seems to be one of the few with members that may be able to provide some positive, proactive advice.

In a nutshell i am a UKC, my wife of 3 years a USC n our baby now dual nationality.

We are in Naples visiting family to introduce the latest addition to our family and since being here, weve fallen in love with the culture and lifestyle, and after some family encouragement we really want to stay.

My wifes Uncle is financially secure enough to co-sponsor us amd suggested we simply stay in the country n apply for AOS.

My wife and family are really pushing this, but im nervous as it just seems a bit shady to me... Am i being overly wary..?

I would really value any advice from those of you in the know as i feel like im between a rock n a hard place right now.

    Thanks in advance.

I can't really advise you whether you should stay in the US or not. That is really up to you.

However, for filing greencard, start with https://www.immihelp.com/family-based-greencard/ then read

      Hi there,

I can see how the whole process can seem rather unfamiliar or even shady if it's an idea you hadn't really explored. Your case is really straightforward. There is no doubt your marriage is real. You have a child. Your wife's uncle is willing to sponsor you - huge plus. And you've been married to your wife for 3 years; i.e., you will qualify for the 10 year green card when your case is adjudicated.

The only downside is that you won't be able to travel until your Advance parole is approved but that really is about the only inconvenience that I can see with the information you have provided.

If you need to return and tie loose ends, do that, then come back and file for AOS. You won't even need a lawyer. It's that straightforward.

      Best of luck!
