  • L1 Visa to Green Card - Travel

    We're starting the green card process for my wife and I wanted to know if she needs to apply for the advance parole to travel internationally if we file her I-485. She has a valid L1 Visa through her employer and we've been married a year (I'm a US citizen by birth). The visa is valid for several more years.

    We have international trips planned this year and we don't want to have her I-485 application abandoned because of it. I've read conflicting info so just want some clarification. Thanks!

    If she has L-1 status when she leaves and she will re-enter using an L-1 visa, her I-485 will not be abandoned.

    She should still apply for Advance Parole just in case; it is free so no reason not to. But she can leave and re-enter using her L-1 visa even before she gets Advance Parole without abandoning her I-485.
