  • Hello. I have a question.

    I married almost 4 months ago. My husband is an US citizen so I will try to adjust status based on marriage. We hired a lawyer, I have read a lot and it is recommended to provide the most evidence to prove it is a bonafide marriage. I gathered a lot of photos, wedding written cards by family and friends, as well as engagement cards we both received. Also a wedding invitation, rsvp cards returned to us. She said not to send so many stuff and to keep it until the interview. She said to only send a couple of photos, joint bank acct, lease and that will be fine. Is this so? Also she says with his US passport and social card is enough. He doesnt need to send birth certificate. Is this the case? Thanks everyone in advance for the help.

    I would gather everything you can to prove the legitimacy of your relationship, send them leases, joint bank account statements, insurance, utility bills etc and some pictures. The rest you can keep and bring with to the interview and show the officer. They may take them, they may not and say they have sufficient documents. I also would include your spouses birth certificate. Its better to send more and them not require it, then to have your case held up for an RFE.

      On the instruction page for i-130 it lists some documents you can take for proof of relationship and a birth certificate for the petitioner is one of the documents to prove citizenship. IDK what is up with these lawyers. SMH. Go and read the instructions for yourself and you will see. Here's the link; https://www.uscis.gov/i-130 Select i130 instructions and read from page 6. It also has the the list of concrete evidence of bonafide marriage. Give them what they need and you can add just a few more not much. I followed the instructions and my app was accepted, checks cashed and I'm waiting for my NOA in the mail

        Any one form of proof of citizenship is enough. Since he is providing a copy of his US passport, that is enough.
