  • Concurrent filing of i-485, i-130, i-765 and i-131 October 2017

    Hey all,

I am new here, I am petitioning for my husband. He and I were married in his country, the Faroe Islands, in August 2015. We came for a visit this past summer, in July 2017. While here, my ex, who had not allowed me to bring any of my children (i have 4, 2 wanted to come, and 2 wanted to stay with their dad) with me to the Faroe Islands and asked me to grant him full custody of them, decided he didn't want them anymore and basically forced me to stay in the US to take care of my kids. I was going to stay alone, but my new husband, much to my surprise (as he is not a big fan of the US or it's politics) decided to stay with me and file for residency. We had come with only suitcases and his family had to pack up our apartment and move us out because we haven't been back since. The plan now is to stay here a few years until we are in a better situation to be able to afford to move back the the Faroe Islands with all of my kids.

With that out of the way, I want to ask what others experience is with concurrent filing within the US. We were told by our lawyer that it should take 2-3 months to get his work permit and advance parole.

We mailed our application packet on the 29th of September, 2017. They received it on October 2nd and sent notice on October 6th, 2017. We received his biometrics appointment notice shortly after, and he had them done on October 30th, 2017.

It is now a week into February and there is no movement. We have called USCIS multiple times, almost daily for the past couple weeks, our lawyer sent something asking for information in early January and there was no response. Today we went to our local USCIS and were told basically to hurry up and wait, because it is slow for everyone right now.

He has a ticket to go home mid march for his Fathers 50th birthday. He rented a hall for his dads birthday, without his dad knowing and wants to be there as a surprise. In his country, milestone birthdays are a VERY BIG DEAL, not just family and a few friends, but basically everyone you know is invited to a party that starts around 6pm and lasts into the wee hours of the morning, with more food and booze than you can imagine. He is very concerned that he will have to cancel his trip and miss his fathers big day. He already missed becoming an uncle, his only sister had her first baby in December, and her Christening was this past sunday. My husband was supposed to be there for that as well, as he was made her godfather.

They are telling us it could be april before we see anything, and I don't understand why because others who filed around the same time or even later already have their advance parole and work permit.

Aren't they supposed to go in order? They say they have our application and the background check came back fine. So what is the hold up?

We asked to expedite his advance parole but they say we need an emergency situation for that, and a birthday doesn't qualify.

I don't know what else we can do. Today is 127 days since USCIS received our application.

Our next step is seeing if our local state representative can help.

    Any suggestions?
