  • I-485 work related question

    I am the husband of a US Citizen and we got married last october 2017. I have been living here in the US since 2008 (I was 15 and a half years old back then), and have been working under the table since I was 19 yrs old. I met my wife when we were 21 yrs old and fell in love. She had a kid and now i consider him as my own. We practically lived close to each other since the beginning and only decided to move in together this march 2017. Now my question is do i disclose my previous works(I had 3 jobs in 6yrs) prior to our marriage? Is that included in the "waiver" due to the fact that im married to a us citizen?
    Concurrent I-130 and I-485 with I-765
    03/12/18 - Documents sent to CHI Lockbox
    03/14/18 - Documents received; PD
    03/26/18 - Received NoA email/text
    03/27/18 - Checks cashed
    03/30/18 - Received NoA mail
    04/06/18 - Received Biometrics letter
    04/18/18 - Biometrics appt done
    04/23/18 - USCIS received RFE
    05/31/18 - Case ready to schedule an interview
    08/09/18 - EAD being produced
    08/16/18 - EAD in hand

    Yes unauthorized employment is ignored when you are an immediate relative of a USC.

      Did you enter the US legally? If not you generally won't be eligible for I-485.

      Note that there is no "waiver" involved because there is no ban -- there is no ban for unauthorized employment, and there is no ban for unlawful presence (no matter how long) if you haven't left the US.

        Yes I was inspected when I entered the USA. I have my I-94 and the Expired Non-immigrant Visa. I haven't left the US since and have been residing here since 2008. Thank you so much for your reply! This forums really helps because I was in a debate with my wife on whether to disclose the unauthorized employment and I told her that not disclosing it would cause too much trouble and I have told her that I'm her spouse, the unauthorized employment would be be disregarded.

        So just to make sure,
        I will check YES on part 8 #16 and #17
        Concurrent I-130 and I-485 with I-765
