    Great community here. Lots of help and love. Much appreciated during this confusing voyage.





    So today, I received this RFE from USCIS.

    Having read over it a few times, I think I got the knack of what they are asking for, even though in typical style, it is a little confusing.

    In an effort to make this process easier, I have color coded the questions. [Due to upload limits the second and third pages are google links]

    RED - Is this asking me for MY tax documentation, or my wife, or both?

    We submitted the tax return copies with both our names on it from last year. We filed jointly, but I was just on there as 0. I was out of status and not working. I am now working, as I indicated on my I-485 in the applicable box. I mostly think it's asking for my wifes info, but now that I checked I do work, I'm not sure, though this year is the first I had worked and would file taxes, but have not at this time. Although I'm guessing my information is irrelevant because.... (follow below)



    PURPLE - This is the most confusing part of the request. Even by herself, my wife absolutely and unequivocally makes more than 125%. I do not get why, barring some simple mistake my copy of the application shows we didn't make, they would be saying this to us. Is this just some automated line that comes up when there's a mistake or problem?


    ORANGE - We did not include any of this evidence on the application, just a copy of my wife's tax return, federal and state. It was just a copy without any of this evidence, though my wife swears up and down it did not ask her for that specific evidence. Again, this was just a copy printed from her private files, not a transcript from the IRS. Is this our AOS related issue and mistake? If we were to procure an official transcript, would she still need the W2s etc?

    BLUE- SOLVED: I worked out that I sent a birth extract instead of a birth certificate (and a crappy copy at that). My mum took a look at it on facetime and called me a dish head (rightfully so), and told me she would express a certified BC to me, so subsequently i DO NOT require help on this, just figured I would include the entire letter for reference.


    I want to obviously get this cracking as soon as possible, so any help is much appreciated.

    ORANGE - YES, SEND ALL W2'S AND I WOULD ALSO SEND FOR ALL THREE PAST TAX YEARS

    STOP BEING A DISH HEAD ���� AND SEND ALL TAX DOCS SHE HAS FILED (RETURNS, W2'S AND ANYTHING ELSE).

        So u guys only sent copies of federal and state tax returns without W2 forms? Also, on the i864 instruction page it said do not send state tax returns only federal 😕

          Yeah that's about the gist of it. I didn't actually fill out the 864, i just assembled the package and did my forms, so I think she just didn't know to send any W2s.

          To be fair this is her first USCIS rodeo, where as I have had visas of one description or another several times. Oh well, looks like with everyone's help we worked it out.

          Had biometrics today, it was nothing like I expected, even with my experience. It was a little store front in a strip mall and the entire process took about 3 minutes and the security guard and fingerprint lady were both really nice. They didn't even ask my about my cell phone I had in my hand or metal detect me or anything.

          Easy done

            I went for my biometrics in NYC thinking I was going into FBI or CIA.... it was more like DMV.

              hahah real talk man. It was even less than the DMV in my experience. Place was utterly empty, which I was grateful for.

                  Hi all,

                  I have received the same RFE today (PD-24th Jan)- asking for I-864 supporting documents. I have exact same description like you highlighted in RED and PURPLE.
                  When we filed I-864 along with I-485, we attached below documents :
                  For Year 2018 (Current Employer Job Verification Letter & 2018 Paystubs)
                  For Tax Year 2017 (Last 6 Months Paystubs & available W2 , I did Not send TAX Return as in January I didn't receive W2 of my second employer), so we only sent the Paystubs and available W2s. (income aprx 35k)
                  For Tax Year 2016- I sent TAX Transcript from IRS (Not W2s) Income aprx 16k (As I was student and working)
                  For Tax Year 2015 - I sent TAX Transcript from IRS (Not W2s)

                  My questions :

                  Are they asking for my recent tax year (2017) documentations as we didn't send Tax Return? If I send that , will that be enough?
                  Now that I have all my W2s and I am planning to file my 2017 Tax Return this weekend. If I attach and send that 2017 Tax Return document along with W2s (Not Tax Transcript as It wont be available yet) , will that fulfill this RFE ?
                  Also, my income in 2017 & 2018 is definitely more than 125% FPL guideline(As per 125% guideline, for 2 person - it should be 20k) but in 2016 Income was below the 125%. will that affect my petition?

                  Please experience person share, I need all of your guidance in this tricky process.
