  • Sponsor between jobs (i-864) at interview time

Hello! I am my husbands sponsor and we have just gotten called for our interview (NYC, we filed 4/2017).

I filed the i-864 at the time of filing with supporting documents. Currently, I am between jobs, and do not have 2 months of paystubs, nor an employer at present. I am not collecting unemployment. I do have our 2017 joint tax return, which shows I make more than the amount required, as well as my husband making more than required on his EAD.

The letter states to bring evidence (employer letters + 2 months paystubs) if not submitted previously.

What is the best way for us to handle this situation? I would greatly appreciate any and all suggestions. Thank you!

You can prepare an alternative i-864 that adds your husbands income plus a letter from his employer basically they will still employ him even after he gets a green card. If they ask you present it and if they dont ask, you dont mention it either. Google using intending immigrants income for i-864 if you have any questions.

This probably the one instance where I think that just riding the wave is best. Be prepared, though, have an alternative I-864. I went through this process with my former spouse and I was the beneficiary. However, my spouse was unemployed and I presented a letter of employment certifying my salary and that I would be employed even after getting my green card. So I was my own sponsor.
If anything, I would volunteer the 2017 joint tax return and that will probably end right there, since your income exceeds the 125% poverty guideline by a large margin.

      Best of luck!
