  • My husband has been unemployed for almost a year. How to file i 864?

    Hi everyone,
    So we got married late 2017. My husband had been unemployed since October 2016 all the way until September 2017 when he finally got a job, which he later had to quit after only about a month. He's been unemployed since.
    He also lost all his past W2, all we have right now is his newest W2 from the above mentioned 1 month long job and my W2 from last year when I was on OPT.
    Our parents from both sides are supporting us financially at the moment.
    How can we file the i 864? Should wee ask our parents to put some money in our checking accounts?

    some money in the account won't be enough. you will need a joint sponsor since he isn't working.

      Samlynn is correct, you will need a joint sponsor, also in the case that they ask for previous tax/income history such as W2, etc you can download copies online through the IRS. it's not the actual W2 itself but it is a summarized version of your tax returns that you filed during previous tax seasons.         Thanks a lot everyone. Will having a co sponsor lessen the chance of either i485 or i130 getting approved? Im very nervous because by the time we got married, I was already 1 month out of status. My husband said we could wait until he got a job to make things less complicated, should we?

          sponsor

          a joint sponsor is not a negative thing. if you have someone that will do that for y'all then do that otherwise wait until he gets a job and then he can get a letter from the employer explaining how much he makes, etc.

            Thank you! Im glad to hear that, Im sure my in laws can help. It's just we already don't have a lot of supporting documents (my name isn't on the lease since my visa expired, no bills or insurance together, etc) so I was afraid it would even be more risky to let them see that neither of us has income

              proof

              try to get more documentation. go to the bank and open a joint account. get letters from friends to attest to your relationship. print out emails that you sent to each other. take pictures. you want to have as much as possible to prove that your relationship is real.

                  Yes, that will need to be provided as part of the the sponsor application and separate from the documentation you need to have for your relationship proof.
