  • Greencard interview on Expired Passport

Hello - My passport at the time of GC interview would have been expired. Is it okay? Will i get approved on an expired passport for my GC? I already have my EAD as a form of ID and my licence and state ID.

Please let me know if that would be an issue.

An expired passport is not an issue for your Adjustment of Status interview.

Okay, thank you. What about at the time of removing conditional greencard to a permanent one?

Passport is used for identification only. Just because it is expired does not make you a different person. It will not be an issue.

While expired passport may not be an issue, it certainly doesn't hurt to get a current one. Although I have not been given an interview date yet, I estimated that my passport expiration date April 29 was fast approaching. So I got a new one, way in advance, by going to my country's (Jamaican) embassy in Miami, Florida.

Still waiting on interview date, applied July 18, 2017, ready to be scheduled for interview since August 23, 2017. But I got new passport early February.

I cannot renew for some other reasons. The embassy we have is not friendly and I had a bad experience there one time.

If it won?t be an issue then I rather don?t. Just don?t want to go to my embassy and face those guys.

I rather wait until I get my citizenship. We don?t have any plans to make an international travel until I get naturalized since it?s only 3 years or so

You are not required to have a passport to adjust status or to be a permanent resident, so if you don't have a valid passport, that is fine. You will need an ID to get into the biometrics appointment and interview, and people usually use a passport as the ID, though if you have a state driver's license/ID or EAD that should also work.

Once you become a permanent resident, if you wish to travel internationally and can't or don't want to get a passport from your country of nationality, you can get a US Re-entry Permit, which is a passport-like booklet that you can use to travel internationally and which many countries will issue visas for, although in general it's less convenient than a passport. You can also travel by land to/from Canada and Mexico with just your green card.

This is my personal opinion and is not to be construed as legal advice.

                    Zee,

There is no requriement that you have an unexpired passport when applying for "Removal of Conditions."
