[While this is in reference to a family-based green card application, my questions are applicable to I-485 AOS in general. Mods, please move this topic to a different board if necessary]
Hello,
My naturalized USC spouse is filing concurrent I-130 and I-485 applications to sponsor her parents for permanent residence. They entered the US on B2 visitor visas, and are still within their visa limits. They have been staying with us at our family home in the US, which will become their home as well after they immigrate. I need to provide (a) the parents' current address, and (b) the parents' address history for 5 years: I-130 (Part 4, Item 11, Page 5) and I-485 (Part 3, Item 5, Page 4).
My question is:
Do we use our family home in the US as the parents' current address and include it in the address history with a start date of their arrival in the US?
I'm not sure it is correct to list them as "living" in the US at that address when they entered on a non-immigrant visa. In fact, we did not intend to file an AOS, our original plan was to file just a I-130 after they returned to their home. That plan changed recently. On the other hand, if I only use their foreign address for those sections, I am a bit confused what to list as their start date at our US address for future forms that require their address history. I'm not sure what accurately represents our situation.
FWIW, when I asked this question to an immigration lawyer during a consult, her recommendation was to *not* include the US address. I'm just looking for second opinions based on others' experiences with USCIS.
Thank you for any clarifications you can can offer.
