Is there a time limit to submit a request for an interview for adjustment of status?

  • Is there a time limit to submit a request for an interview for adjustment of status?

    I married my wife (B2 VISA) 8 months ago and we have not requested an interview date, nor have we filed any other documents with USCIS. My mother-in-law had breast cancer which took a turn for the worse approximately one month after the wedding. My wife is the only cargiver and she has been extremely busy commuting and attending to her mother that we have not paid any attentiom to the interview process.
    My questions are:

    Is my wife still eligible for permanent residence?

    If so, are there any additional challenges we may face because of the length of time since our wedding?

    What is the maximum amout of time allowed to request an interview after marrige?

    i'm not sure if i understand what you are asking.
    Have you filed any paperwork yet like 130/485/765/131?
    If not, i do not think there is a limitation on how long you file after you get married.
    As long as your wife entered the country legally you should be ok.

      No, we have not filed a single document yet.
      We finally have help with mom so I am just going to file now and hope for the best.
      Accually, it has been about 10 months. Wow

        it does not matter how long you have been married...you can submit your documents whenever you want but the sooner the better to get her status adjusted. good luck

          There is no time limit. If anything, waiting only works to your advantage. By the time your case is adjudicated you will have been married for 2 years. If that's the case, she would get the 10 year green card and not the conditional green card.

            you should file documents now.. after you file its okay for your wife to stay (overstay) in us since she entered legally (b2 like me)
            after you file documents it takes 4 to 7 months waiting game for the interview and cards. FOr EAD 2-3 months after filing for green card 4 to 7 months of waiting

              There is no maximum amount of time. what you need to know if that after you start the process your wife will not be able to leave the country for at least 4/6 months until she receives advance parole or green card. It would be better to wait until her mothers health has stabilized enough for her to be away for an extended period of time.
