  • Different address for spouses

    Hubby applied for I-485 on L1A and I am on H1B . We are living coast to coast with different address on our I-485 application.
    Will there be problem for I-485 approval as we are not living together? We have been married for 10 years and have a kid

        USCIS looks at the whole picture rather than isolated incident. There is many valid reasons that cause spouses to live apart. Because you live apart your marriage will likely be more scrutinized than normal so secondary evidence of ongoing long long distance marriage plays center stage. communication logs - text, social media, skype very important. Tickets of travel to see each other, joint insurance where possible, commingled finances and the like. You might consider cosulting a lawyer as your case is a little more complex than most.

          Can my AOS be denied if me and my spouse don?t live together?

          We met each other online a year ago as I was preparing myself to come to USA to study. I came visit him and after that I change all my plans so we could be on the same State at least. I was supposed to study in another city but when I arrived he just convinced me to transfer to a college in is city. Unfortunately due to financial problems in my family I was not able to continue School this semester. Because we didn?t want to be apart, for who knows how long, until I save enough money to come back, we decided to get married earlier than we have talked. We got married after my status be terminated because we wanted it to happen in a special day. We live 5 minutes from each other and we are together every day, but because when I move I had my mom with me and we both have one child each one, we decided to live in separated apartments. Problem is my lease will only expire in six months and I am not able to move until then. On the other hand he?s lease will end in one year and his not enough room for everybody. Anyway he wouldn?t be able to move to my apartment because I have a housemate and no space for all of the kids. We just oppened a joint account, I put him in my auto insurance (be cause he always drive my car), we have tickets and boarding passes, some postcards and ******** records... should we wait until get more evidence or just start the process? We will apply in Columbus Ohio, probably. thank you.
