Plz help, my I-765 was rejected, i had filed concurrent with I-130 and I-485

  • Plz help, my I-765 was rejected, i had filed concurrent with I-130 and I-485

    Hey guys im hoping someone could shed some light. Just rcvd notice that my I765 was rejected due to not sending the sufficient fee. From my understanding the fee is waived when filing concurrently with I-485. Am I wrong??? We sent the 85$ biometric fee for the I765 but not the 410.00. We received everything back that pertained to the form I765 however not the 85$ money order. I just got off the phone with uscis and OMG what a horrible experience. The officer advised me that IF I read on the instructions that the fee would be waived to just resend the package with a note stating that the fee should be waived as stated on the instructions. ARE YOU KIDDING ME??????? I called to get an answer and he said he was not sure, he got very mean and rude and long story short I got no right or wrong answer from him. just got setup for a callback from a "tier 2" examiner.

    Just need to know if sending the forms concurrently if that waives the fee for the I765. I would greatly appreciate some feedback. Thanks everyone.

    You are correct. When filing for AOS (I-130, I-485, and I-765), the fee for the EAD card is waved. Aka you "only" have to pay $535 for I-130 and $1225 for I-485. I don't understand why you sent $85 (biometric fee) for the I-765. You just don't attach any money to that "file package" at all. Maybe whoever was working your case got confused as to why you only attached $85 instead of the full fee for the I-765. FYI: I've heard that our files (I-130, I-485 etc) get separated and processed by a bunch of different people which might explain as to why that person didn't know that you were filling concurrently.

    USCIS update - EAD being produced and sent to me: 5/25
    EAD sent me to: 5/31
    I-485 "ready to schedule interview: 6/1
    EAD in hand: 6/4
    i485 interview notice has been sent in the mail: 6/4

      Thanks so much for the reply! That's what I told my husband that maybe they get separated. Why did I send the 85$? I don't know I couldn't figure out if that was waived as well so I just sent it anyways, very stupid of me
      Hopefully someone calls me back soon, if not I will call back tomorrow and hopefully speak with someone nicer and more competent.
      Do you think I should send the form back with the notice of action rcvd for the I-130 and I-485 and a letter explaining the situation?

        Don't need to explain. Just file I-765 now with the I-485 receipt. It is still free.

          Awesome, can I bug you with one more question plz.? Was unsure if I could return the exact same form back that they sent me, or does it need to have a new date and signature? I would just print out the pages that contain date and signature, but wasn't sure if I could just submit the exact package back that was dated 02/05/18.

            Hi there, I also filed concurrently and got the same rejection notice due to insufficient payment, added the $85 for biometrics and resent but got another rejection notice. You never updated your thread and I’m curious to know if you were able to solve and move on with yours. It’s driving my husband and I crazy as we’re confused on what is going on with the petition.
