  • Can I file for I-485 before I-130 has been approved if my priority date is current?

    Hi,

My wife is a green card holder and she had filed i130 (Petition for Alien Relative) for me in March 2016. I'm in the USA currently on F1 visa (finished my Master's, currently on OPT). My priority dates is April 3, 2017 so I guess I'm current right now since March Visa Bulletin states May 1, 2017 for F2A. My OPT is set to expire on June 11, 2017. So my question is Can I file I-485 before my I-130 gets approved? I don't want to be out of status. Thanks!

    Yes you can.
Just an opinion; Not legal advice.

Were you in the same situation or do you know someone who had experienced the same? Thanks!
