(I"m writing for and as my friend.)
I entered EWI '98 . I retained an Attorney on April 2, 2001 to file my I-485 based on my marraige to a US citizen under 245(i). I had by then overstayed 3 years. I paid him all his fees plus the $1000.00 penalty. After lots of missteps, I was interviewed last year and found out to my horror that:
(a) My application was not filed until August 6, 2001;
(b) the $1000.00 was never paid.
In July 2005, USCIS sent an approval letter for the I-130 and shortly after a denial of the I-485. I was also informed that my file had been forwarded to the US consulate in Nigeria. I know that I'm subject to a 10 yr bar and also that I'm a poor candidate for a I-601 Waiver ( I have no minor children, no sick/disabled relative, not educated/professional etc.)
I reported the Attorney to the DC Bar and they are awaiting his response. I have good proof that he was paid and of the date of retainer and am confident that he will be disciplined.. But what do I now do? I have not yet received a date for the interview but I know going to Nigeria means only one thing: I will not get to return! Please, anyone with 245 (i) knowledge /experience?
