  • Affidavit of Support, I-864 question

    Hello All,

I applied for adjustment of status through marriage some months ago.
Today, I received a letter for request of evidence based on the fact that my wife income isn't sufficient. I have a few questions and I really hope someone can help:

1-At the time I filed my papers, I didn't have a job so we used only her income. Now I have a job with sufficient income, can I use this income for I-864? if so, should I file a new I-864 form or just send my income evidence?
2-In the letter for request of evidence, they need my wife's pay stubs for the last 6 months. She is in a new job now and in those 6 months, she stayed without a job for about 2 months. What should I do about this?
3-I have a car registered in my name, the immigrant. Can I count this as a household asset?
4-If I get a joint sponsor, should I count my income, my wife's income and the sponsor income? And again, does this require sending a new I-864 for or just the evidence?

Thank you all and good luck

It make me nervous to see that they can still com back to me and say that my husband didn't make enough money, considering I make 3 times what he makes so money is not a problem.
1.The total household income is your income plus your partner's income if you guys live together. I did sum up our incomes since we lived together when we filed.
2.Can't really say 100% what's the right answer, I would send a letter from the employers stating when she started and stating that she is still with that job and all the paystubs you have available in the last 6 months.
3-chekc this page can't copy and paste sorry.
4- if you include another sponsor you have to prepare the 864 for the join sponsor. Not sure if you have to file another for yourself, call the USCIS in that case to be sure which forms you should send.

    Hope this helps

      Thank you

Thank you for your answer. That was really helpful.
I still have a question unanswered though.
When I filed, I didn't have a job so I used my wife's income only. Now they say proof for this income isn't enough but now I have a job with enough income. So can I file a new i-864 with my income although they only want more proof for my wife's income?

I would suggest you to read the instructions again to be completely sure of what they want in terms of proof. I remember I sent the last three years of my taxes too even though was not necessary. Besides this it's difficult to respond to your question. Is your job permanent? Do you have proof of income? If I were you I would still send a form with a joint sponsor.

I have a question for you: how long after you sent the application you received the RFE for your wife income? My husband has had a job continuously for the last three years but I think he barely made over the poverty line. My salary is really good though so I don't know if is salary only is more important than both our salaries combined, considering also that we have been living under the same roof for two years.

I called them and they said I can add my income if it's in the same household. So I'm gonna do that and send a new I-864 hoping that they use the new one
The sent me the request after about 8 or 9 months since I filed.
