  • I need some help please

    Hi,

    I'm on F1 visa for now and have married to an American citizen. My F1 visa expires on June 15, 2018. I applied for the green card, EAD and Advance Parole. All of these cases were received on January, 29, 2018 and got bio-metric done on Mar, 1, 2018. But I have not heard anything after this. I'm planning to visit my own country at the beginning of June for three weeks and come back to the US at the end of June. I do have B1/B2 visa too. So 1) can I still go back to my country and come back to the US using a B1/B2 visa if I can not get my Advance Parole document by the beginning of June? 2) Will this action jeopardize any of my cases, such as EAD and green card? 3) What will happen or what I can do after my F1 visa expires on June 15, 2018?     You will automatically abandon your I-485 if you leave the US while it is pending unless 1) you have received Advance Parole before you left and return on that Advance Parole, or 2) you had H1b/H4/L1/L2/K3/K4/V status when you left and you return on the same type of visa. Since you have F1 status, you can only leave and return on AP. You cannot use an F1 or B2 visa to enter (or you will abandon your I-485), so when your visa expires is not relevant. EAD/AP can take 5-6 months these days, and there is a good chance you won't have it by June.

      Here is the link to information on emergency travel. You can request for your AP to be expedited but it has to meet their criteria for emergencies/humanitarian reasons (death in the family/immediate relative is very sick).

      If you have trouble securing an infopass appointment online, you can use two google extensions to find one faster. Super auto refresh and visual ping. If you google "How to get an appointment on infopass", the 3rd result is a thread on vis@j0urn3y and it explains how to set up those two extensions.

      They will approve it. You just have to show there is an emergent reason for you to travel and for the AP to be expedited.

              It is free. For the address, see here, under "Applicants with a pending Form I-485", and find the address corresponding to the first 3 letters of your receipt number. It is probably going to be the Chicago Lockbox in your case.

                  Might be a little off topic but how can you have F1 and B1/B2 at the same time?

                    I am going to go out on a limb here and guess that the B1/B2 was issued first. Came here, thought it'd be great to study here; then applied for F-1. The B1/B2 was likely issued for 5 years and there were no overstays, of course. It is also possible that the B1/B2 is on an expired passport. That does not invalidate your visa. You simply travel around with your expired passport + B1/B2 and your current passport. As newacct explained, though, OP is on F-1 now and may only leave the US on AP.
