  • NBC transfer and interview timing

    Hello all,
    I am on AOS for an employment-based GC.
    I-140 has been approved in october '17. Since then I have received the EAD/AP card in February '18 and case has been transferred to NBC late Feb.
    Since then nothing. Maybe it is because my field office is San Francisco which must be overwhelmed.
    Does anyone have an idea of when I'm supposed to get an interview notice or anything else?

    Not personal experience, but I heard from collegues that will take 3-4 months (with no RFE) to get GC in your hand.

        Just to make sure, I'll ask. Is your priority date current? According to some posts, the San Francisco office is cranking out those interviews rather quickly. People with a mid january PD got interviews for mid to late march. The nice thing is that after an interview, USCIS has 120 days to issue a decision. However, if there are no outstanding questions or missing evidence, and the priority date is current, most cases are decided in 30 to 60 days after the interview. I'd say you're in good shape.

            I'm in Miami so timing is different. Processing times for employment based I-485's in Miami are 11.5-23.5 months.

            My application was sent in mid November 2017. My I-140 was approved in late November and I got my EAD/AP in late February. I was notified on January 14th that my case had been sent to the NBC. Since then, no updates on either of the websites to check the progress. Until Tuesday this week when my lawyer got my interview notice, May 1st. Online status still remains at "case transferred".

            I had a look at San Francisco and processing times are slightly less than Miami but I think they make these dates up as my moved a lot faster than processing times suggested.

                Upon perusing outside sources, I ran into this article that you might helpful. It nicely takes the mystery out of what happens backstage. "Behind the scenes, USCIS will transfer your pending I-485 from its current USCIS Service Center (either the Texas Service Center or Nebraska Service Center) to the National Benefits Center (NBC), a national clearinghouse that coordinates operations with the USCIS field offices. The NBC will organize your file and coordinate scheduling of an interview date and time with the USCIS field office nearest your residence. The NBC will mail you a notice informing you of the date, time and office address of your interview. After sending your appointment notice, the NBC will ship your file to the field office before your scheduled interview." http://www.dinsmore.com/publications...loyment-cases/

                So basically, you're up next. They will either send an interview notice with your appointment date OR an notice of an upcoming notice which pretty much reads "we are in the process of scheduling your interview. Once scheduled, you will receive an interview notice with your appointment date and time" (I am paraphrasing).

                One last thing about processing times, remember that for employment based adjustment of status, that's all work visas together. Thus, it is a little harder to predict. What is important to know is what the processing times mean. In the time range "8 months to 15 months", 8 months is the time it takes to process 50% percent of the cases and 15 months is the time it takes to process 93% of the cases. After the interview, USCIS has 120 days to issue a decision. That's 4 months right there and it never takes that long. So I'd say hang tight.

                    No, we did nothing. Honestly there was nothing to do as "normal processing time" for Miami is 11.5-23.5 months so they would simply have replied saying to wait. I'll update you on any further progress after the interview.
