    Hey guys,

    I have read a lot of posts on the forum and I would like to thank you for all the help.

    I wanted some information regarding the application I am working on right now. My wife is sponsoring me for a green card, I am on my F1 and she is born here.

    I have started getting things ready and I had a questions

    - On the forum I read that with the i130 we need the i130a and not the g-325a for both of us, could anyone with a little idea help us what the best document would be?

    Below is the complete list of documents I am preparing, I would appreciate if anyone could have a look and tell me their thoughts

    No form uses G-325A anymore. I-130 petition for spouse needs I-130A. I-130 for spouse also needs lots of evidence of bona fide marriage.

      I don't see anything on the list that shows proof of marriage. I would include things like, bank statements from a joint account, any notes payable that have both your names on it, utility bills with both names, local club memberships showing both listed, cellphone bills listing a family plan for both, etc etc.

        Hi there,

        There are a few things. I will just go ahead and list them here:
        - G-325A is no longer used. The information on it has been incorporated into other forms.

        - Forms are updated constantly. Here is the link to sign up for Forms updates. Just enter your email address to get notifications. https://www.uscis.gov/forms-updates **Always download forms directly from uscis.gov and look at the expiration date on the top right corner, but most importantly, check the edition date at the bottom left corner AND on the page where you downloaded the forms.

        - unsolicited advice: front-load as much evidence of bona fide marriage as you are able to with your application. That will make your interview easier and you will avoid triggering a high fraud level. Everyone is assigned a fraud level. I-130 Instructions, Page 3/12 states "Evidence. At the time of filing, you must submit all evidence and supporting documentation listed in the General Requirements section of these Instructions. USCIS may issue a Notice of Intent to Deny (NOID) or a Denial Notice for petitions filed without the required supporting evidence"

        - Instructions, page 7/12 - lists what USCIS considers to be evidence of bona fide marriage. They weigh financial ties the heaviest. Think - if your trust someone enough with your savings account to know he/she won't empty it and run. That's the kind of thing they're looking for. Here's what the instructions state on page 7/12:

        (from general requirements) NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may prove you have a bona fide marriage:
        (1) Documentation showing joint ownership of property;
        (2) A lease showing joint tenancy of a common residence, meaning you both live at the same address together;
        (3) Documentation showing that you and your spouse have combined your financial resources;
        (4) Birth certificates of children born to you and your spouse together;
        (5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital
        relationship. Each affidavit must contain the full name and address of the person making the affidavit; date
        and place of birth of the person making the affidavit; and complete information and details explaining how the
        person acquired his or her knowledge of your marriage; or
        (6) Any other relevant documentation to establish that there is an ongoing marital union.

        - You are missing form I-130A - Supplemental information for Spouse Beneficiary.

        - Translations do not have to be notarized. So if you have not gotten that yet and if it will cost you money, just find someone who can attest he/she is fluent in both English and your language. That's sufficient.

        - Birth certificate; make sure it is the extended version. Some countries have a long version and an Extract. USCIS prefers the long version. Tons of RFEs (Requests for Evidence) are issued for that.

        - If you have not gotten the medical exam yet and your case will be serviced by a field office with long processing times, it is worth waiting for USCIS to issue a courtesy letter noting that you did not send it in and to just bring it with you to the interview. From the date the exam is completed, you have a year to submit it. And from the date it is received by USCIS it remains valid for up to another year if the case is adjudicated within a year. Thus, if timed wisely, you could potentially make it last almost two years. If you send it in right away, then you are using up that first year window. Up to you...

        - If the most current tax return meets income guidelines and if it's well above that, then you don't need previous years. However, if it's cutting it close, then sure, submit previous years if you think those will help. It is optional as the I-864 states. I did not see 2015 listed. Only 2014 and then, the joint tax return. If your spouse was not required to file a federal return in 2015, she has to submit evidence of why she was not required to file. So she would provide W-2s showing that her salary was below $X which exempts her from filing taxes.

        - It is recommended that you do not leave any fields blank. Thus, if a question does not apply to you, you would type N/A. You will have an easier time typing N/A if you disable Javascript on Acrobat reader. If that does not work, you can try filling it out on your computer as much as you can and then emailing it to yourself, then open it from your phone and you should be able to enter all N/As.

        - It also recommended that you make 2 exact copies of the package you send. You will need it for the interview; in case you get separated and having it with you will make you feel more in control of the situation. Sometimes people catch mistakes after sending the file and then come prepared to the interview to have those mistakes corrected. Shows respect for the process.

        - The I-131 Application for travel document has a barcode at the bottom of each page that stores all information entered in each page. Do not make copies of that form. Just print extra copies. You do not want to damage the barcode.

        This is all that I can think of for now. Hope that helps. Take your time with these forms.

          The only suggestions I can give to you on top of what other people told you is: read the instructions. Seriously: instruction for each form have ALL the info you need to know. When I filed my applications I read them every day and every single day I found out something new. Take you time, it is something really important and sensitive, don't rush the process. 15 days more now can save you months of waiting and wondering what you did wrong in the next future. Collect the info, all of them, and when you think you have an amazing proof of your relationship then send everything.

              Got it - I do have the marriage certificate. For the bonafide proof, I have the joint bank account and the joint phone plans. I also have a lease in both of our names. Do you think that is enough

              For the proof, I have the joint bank account and the joint phone plans. I also have a lease in both of our names. Do you think that is enough? If not can you tell me what else would be a good thing to show?

                Could you please tell me what document you are refereing to when you talk about the 13 page document?

                Birth Certificate - I have an indian birth certificate which is standard and the information is mentioned in 2 languages - english and hindi. I also have an affidavit from the indian court about my place of birth and nationality (I got this for a different reason, but might still have it)

                I have an appointment with the uscis doctor in the next couple of days and I shoud have the doctors i693 within a weeks time from now, when I will file the documents. I also have my complete medical records that will simplify my medical exam.

                Tax - We have not had the chance to file a joint tax return yet as we got married after the tax returns were filed, she started working in 2014, and the taxable income was just 1 month, but eventually 2015 and 2016 have enough income (which is atleast 4-5 times the FPL)

                That is an awesome point, I will keep that in mind when I file for the documents and make 2 copies.

                  You do need more. As I said on my message below, you want to send as much as you can. If you're not in a rush, I can upload the table of contents of the evidence I submitted with our I-130. I just need a bit of time to de-identify it because our names and such are on it. I will start working on it now. I was planning on doing it anyway as I know it might help others, too.

                      If India only offers one version, then that's the one. Sometimes people are not aware there is an extended version and an extract. That's why I mentioned it.

                      I know that others on the forum with birth certificates issued in two or more languages that include English, have still submitted a full English translation of the birth certificate signed and dated with the statement that USCIS requires. In your case it's an easy task. All you have to do is copy that and have someone you know certify they are fluent in both languages. It may not be your spouse. It has to be someone else.

                      It sounds like you guys have been married for longer than two years. Is that correct? In that case, you're looking at getting the 10 year green card instead of the two year - conditional green card. Sweet!

                      By the way, in regards to the taxes make sure you figure out if you need to send in W-2's or not. In all honesty, the way that paragraph was written gave me a headache. So I sent them transcripts AND the whole federal tax return with all schedules and W-2s. We only used my income to meet the requirements. All of that is on the I-864 instructions. They get convoluted. Make sure you read them carefully.

                      What field office do you guys have? Have you checked its processing times?

                        I-130 Table of Contents

                        This is what we sent. By the way, anytime we printed anything from an online account, we selected "headers and footers" in settings so that the website's URL would show at the bottom of the page and the date printed at the top. It just adds credibility to your document.
                        I hope this helps. Clearly, this is way more than what USCIS requires. However, I wanted to share it because we did get creative and why not share the wealth? You can make evidence out of anything if you piece it strategically.
                        We also stated on the table of contents what the piece of evidence intended to show. In other words, comments like "serves as documentation that Beneficiary PAID RENT at Street Address. as early as August 1st, 2017 ? before Spouse Beneficiary?s lease started on January 8th, 2018"
                        Why? Because otherwise, this is a mute movie from the 1920s for the adjudicators. But again, that's what we thought and based on that we made our choices. It took us a while to put it all together but that gave us time to check it over and over and every time we found something that needed to be corrected.
                        Another reason we went overboard - you could say- is that we have an age difference which is one of the fraud alert triggers. So knowing that, we just threw everything at them. We had more but the package weighed 13lbs. It was time to stop. Having gone through this process 20 years ago with minimal evidence upfront, I can tell you that was extremely stressful and I would not want to go through that again. ISOs form an opinion about your case based on what they see in front of them before your interview. In fact, your file comes with a note/comments from the National Benefits Center. If the adjudicator over there thinks there might be fraud, well, sometimes those cases get surprisingly fast interviews. People get super happy only to be ambushed by ISOs the day of the interview. So again, this is all personal opinion and not legal advice. It took me a while to de-identify the file and reformat it. So hopefully, you do find something of value in it.

                        Best of luck! If something is unclear, just ask. It might be easier to read it, if you copy and paste it onto a word doc.

                          If India only offers one version, then that's the one. Sometimes people are not aware there is an extended version and an extract. That's why I mentioned it.

                          I know that others on the forum with birth certificates issued in two or more languages that include English, have still submitted a full English translation of the birth certificate signed and dated with the statement that USCIS requires. In your case it's an easy task. All you have to do is copy that and have someone you know certify they are fluent in both languages. It may not be your spouse. It has to be someone else.

                          It sounds like you guys have been married for longer than two years. Is that correct? In that case, you're looking at getting the 10 year green card instead of the two year - conditional green card. Sweet!

                          By the way, in regards to the taxes make sure you figure out if you need to send in W-2's or not. In all honesty, the way that paragraph was written gave me a headache. So I sent them transcripts AND the whole federal tax return with all schedules and W-2s. We only used my income to meet the requirements. All of that is on the I-864 instructions. They get convoluted. Make sure you read them carefully.

                          What field office do you guys have? Have you checked its processing times?

                          I have both my birth certificate and my domicile certificate, if it makes a difference. I will ask someone to do the USCIS translation certification - is the translation format mentioned here (https://www.immihelp.com/translation...s-immigration/) ok?

                          We have been together for some time but we just recently got married, so I have to go through the normal process.
                          Damn, do they even entertain all that information? I mean I got the spare W2s, do I send out the original w2s with the packet r copies of the w2?

                          I checked that the field office that matches my zip code is Newark, NJ. I am not sure if I can write the field office other than the one that services my zip code. The processing time at Newark is 11 months to 20 months. What do you reccomend about the field office?

                            I hope this helps. Clearly, this is way more than what USCIS requires. However, I wanted to share it because we did get creative and why not share the wealth? You can make evidence out of anything if you piece it strategically.
                            We also stated on the table of contents what the piece of evidence intended to show. In other words, comments like "serves as documentation that Beneficiary PAID RENT at Street Address. as early as August 1st, 2017 ? before Spouse Beneficiary?s lease started on January 8th, 2018"
                            Why? Because otherwise, this is a mute movie from the 1920s for the adjudicators. But again, that's what we thought and based on that we made our choices. It took us a while to put it all together but that gave us time to check it over and over and every time we found something that needed to be corrected.
                            Another reason we went overboard - you could say- is that we have an age difference which is one of the fraud alert triggers. So knowing that, we just threw everything at them. We had more but the package weighed 13lbs. It was time to stop. Having gone through this process 20 years ago with minimal evidence upfront, I can tell you that was extremely stressful and I would not want to go through that again. ISOs form an opinion about your case based on what they see in front of them before your interview. In fact, your file comes with a note/comments from the National Benefits Center. If the adjudicator over there thinks there might be fraud, well, sometimes those cases get surprisingly fast interviews. People get super happy only to be ambushed by ISOs the day of the interview. So again, this is all personal opinion and not legal advice. It took me a while to de-identify the file and reformat it. So hopefully, you do find something of value in it.

                              - Yes, that's the translation format they want.

                              - Keep in mind the instructions state to send all required evidence of bona fide marriage with your applications. "At the time of filing, you must submit all evidence and supporting documentation listed in the General Requirements section of these Instructions. USCIS may issue a Notice of Intent to Deny (NOID) or a Denial Notice for petitions filed without the required supporting evidence." How much to heart you want to take that statement is up to you.

                              - Most front-loaders get approved on the spot. That's the pattern I see. They have to check that the documents you're sending are legit and that those bank statements do look like the bank statements your bank issues. It's not hard to Photoshop and fiddle with documents. They know that. So it makes sense that if you bring the majority of your evidence for the interview, you can expect 2 things:
                              1. they may already have an opinion on your case. Humans are humans. First impressions are hard to turn around.
                              2. You may not be approved on the spot because they have to check the documents you brought in and piece the story together.

                              - This following indirectly related. Unofficial sources are reporting that Trump ordered for consular officers to only considered evidence sent with k-1 visa applications and issue a decision with the evidence they have in front of them, and to not accept any additional evidence. So what does that tell us? Officers do sit with your file and try to get a sense of the legitimacy of your relationship before you walk in their office.

                              - We sent all of that because we had it. Again, we do not think of our age difference but in the event that triggers a fraud alert; well, here's 13lbs of our live together since 06/19/16 to appease their minds. To us, it says, we have nothing to hide. Come knock on our door at midnight and you'll find me on the couch and my spouse already bed.

                              - We are already gathering evidence for the interview. We are just adding the next in sequence to each one of the categories you see. This time around, though, we are going to add screenshots from different dates from our video surveillance system. Wanna know for sure if we live together? Well, here it is. Knock yourselves out.

                              - If your zip code is serviced by Newark, then that's your field office. Know that 11 months is how long it takes your office to process 50% of the cases. Here's my prediction. I suspect that many field offices are going to be laser focused on cranking out family based AOS interviews as fast as they can, in order to avoid a bottleneck once they have to start phasing in interviews for ALL employment based AOS applications. So it's about to get crazy. HOWEVER, historically, field offices have picked up the pace when they know a tidal wave of applications is near. A good example is DACA. New York and I think Newark starting cranking them out fast before all the DACA applications started to arrive.

                              - Focus on showing financial ties; proof of being beneficiary on life insurance, retirement account. A good one is to have paychecks deposited to the joint checking account. And there are things that you can just get creative with. For example, our internet company does not have a way of having both names printed on the bill. So we printed the online account settings page, which shows one as primary user and another as full authorized user. Then notifications go to our shared email. Store receipts from say, homedepot, best buy, etc, all those go to our shared email.

                              - A mortgage is fantastic but how many new marriages with one spouse being an immigrant can jump on that? It's not the norm. So you take the next best thing. My spouse moved in with me Nov 1, 2016. I debated whether to inform my greedy landlord because I knew he'd use that as an excuse to rack up my rent which is well below market rates - I've been at this spot for 5 years and they can only raise a small %. I'm a great tenant so it's only been raised once.
                              So long story short. Telling him fell on the back burner, then a new owner took over the building and at this point it's January 2018. So I apologized for not telling him sooner. He said it was fine. Made up a new lease. Did not raise the rent and issued each one of us a Certificate of Rent paid from 08/01/17-12/31/17. This is a legal document that you file with your state taxes. So even though, my spouse was only added to the lease in January 2018, I am at least able to show that my spouse paid rent here as early as 08/01/17. And we stated that comment. Don't expect adjudicators to connect dots of your story for you. They're there to detect fraud and after that, to assist you in adjusting status.

                              - For the I-751 Removal of conditions, you will need that much detail of evidence. They want to see a continuum from day 1 until the day you file the I-751. They don't like seeing gaps. So we figured we would just start now.

                              Anyway, I hope that helps. Focus on sending an error free AOS package. RFEs will delay your processing time and your file will be set aside until you respond. So if that adjudicator is on vacation when your response arrives, well, your response is likely to sit there for a while.
