8months no EAD Can it be Interview straight?

  • 8months no EAD Can it be Interview straight?

    Maybe someone can help me. I am a Canadian citizen married to H1b, I moved to US on H4.

    We applied for AOS separately, he applied in April and mine was filed after I moved in Aug, 2017. We got married in Jan2017.

    He already got his EAD/AP in Aug and still waiting for interview. Whereas me I haven?t even got EAD/ AP yet.

    Questions:

    1) is it possible I won?t get EAD/AP and straight interview?

    2) do you know if our interviews are going to be separate or since I am follow to join, mine would be with him when he gets his?

    3) I read anyone else listed on primary applicants application has to join for interview? So will I have 2 interviews or both will have 2 interviews?

    Timeline to be clear

    Married: Jan 3017
    Husband PD : April 2017, waiting for interview and filed transfered to NBC
    Husband EAD revived: Aug 2017

    Wife PD : Aug 2017
    Wife RFIE: Oct 2017
    Wife RFIE recieved by USCIS : Oct 2017( New PD)
    Biometric : Nov 2017,

    Since then nothing, case still received and filed several SR.

    There's a chance the interview will happen before the EAD/AP gets to you. Unfortunately, these things run on different production lines of the factory and do not really communicate with each other. If they did, they would be able to reallocate manpower to other tasks get their heads above water.

    Here is a link to this article called "USCIS begins phasing in interviews in employment cases". This will clarify your other two questions. From what I understood, you will join your husband for the interview. The intent of the interview is to not only confirm the veracity of education and credentials but also that the relationships are genuine. Read through it. It clarifies nicely what the NBC is. It used to be the MISSOURI SERVICE CENTER. That's why any case number that comes from there starts with MSC. Who knew???


    From another source, a thread from a former USCIS adjudicator, I learned that, adjudicators strive to keep family members together. They also take good care of those applications because it helps their productivity scores to do so. They're in a production environment and have to meet quotas. So when they get a family, wife and kids do not require as much work as the primary applicant. Thus, they like such applications.

    So right now, for your husband's file to move forward, they have to finish up whatever checks they're doing with yours. Once they're done, that's when you'll get the same notice he got. Or maybe he'll get it as the primary with instructions to bring you. Are you signed up for an account on this other site? https://myaccount.uscis.dhs.gov Everyone reports the updates are more detailed, frequent and reliable.

    Since your EAD would have no restrictions on where you could work, you may start applying for jobs. With a job offer, you can get your EAD expedited ; if necessary. As I have mentioned to others, all an employer can ask you is "will you now or in the future require sponsorship for employment authorization?" and you won't, since your sponsorship comes through your husband. With that job offer, you will call the national customer service number and a level 2 officer will guide you from there.

Does not specifically say I should be attending the interview too, just says if elegbiloty based on marriage spouse should come for interview. Since it is employment based and I am dependent I am not sure if I should be attending or not.?

          Do you know if I should be getting a separate interview notice for same day if I am to attend as well?

          Also I had an infopass appointment couple days ago and my aEAD/AP still pending and no officer assigned yet, but lady told me they are requesting for interview to be scheduled for my i485? Seems like mine would be different all together then but I see no ipdates online on old or new website. SIGH!

              Well, congrats! That's a milestone! It's confusing, though. You should know they use templates and delete whatever is not relevant to your case before sending a letter. Each adjudicator has their own style and edits templates according to their own style - within reason. They share templates via IM chat. So that leads to the unclear letter you husband got. It's generic.

              I would suggest calling. This article mentions that if all family members filed at the same time, then they will be interviewed together. Those who file separately, may have their own interview. Should you get no resolution from the call, I would just show up with your husband as if you were scheduled. It they tell you, you are not supposed to be there, then no harm done. You go sit at a nearby coffee shop. But I would not risk not being there without knowing for sure that I am not expected to be there as a dependent.

              Who knows? You might get your notice soon. Otherwise, better safe than sorry.

                I was leaning towards the same to go prepared and if not required sit out but better safe than sorry as you mentioned.

                  Finally got my interview notice today scheduled for May 29, a week after my husbands though. Online still no updates at all other than case recieved on both sites.

                        You know, I am glad you brought that up. I would very much do the same. It's weird to interview you separately. The only reason you are here is because of your husband. You do not work for the company and really, why should you know much about that? If they object and tell you to come back the following week, oh well, so be it. But I have a feeling the ISO will likely be glad to kill two birds with one stone.
