  • Emergency Travel Required..! AP question..!

    Hello,

    Due to medical emergency, My wife has to travel to her home country because Doctor suggested that her mother required a Cardiac Surgery asap . She is the only child and her mother want her to be present as well as my wife wants to be with her. We filed for her AOS in 26th Jan 2018 and Answered the RFE in 8th March 2018. We are still waiting for EAD/ AP. But now its emergency situation and she really need AP asap. What should we do? How we can expedite AP application? though the surgery is after couple of weeks but we want to start the expedite process now. Can we do that? Please help us.

    I think you need a document to show that your wife?s mother has a planned heart surgery. When you have this dokument in hand call USCIS and they may ask you to fax it.

    Personally, I dont have a similar experience and did not expedite the proccess of getting EAD or AP.

      I really appreciate your response. Do you know, Can we walking to USCIS field office to request with this document?

        walk in

        it is my understanding you cant walk in, you may need an info pass, I would try calling the customer service line to see if they can share some light on what are your options to request expediting AP

            Where to file the Form I-131 depends on the benefit sought. See the form instruction page (PDF, 267 KB) for details. Your local office may accept an emergency advance parole application if you are experiencing an extremely urgent situation. Business trips, weddings, holiday parties, and other planned events would usually not be considered an emergency situation. If you are filing Form I-131 for an emergency travel document at your local office based on an extremely urgent situation, you are encouraged to make an Infopass appointment first. "Make an Appointment (Infopass)."

                  Remember that if you are on a valid F-1 and you file for AOS, the F-1 visa will not be valid for re-entry. You should be able to get the AP expedited. Were you able to talk to someone?

                    Not Yet. I am trying to get an Infopass appointment but I am not seeing any available spot. Also I am waiting for the Medical Documents from the home country so when I call USCIS and if they ask for evidence we have that handy to fax them.

                    I have couple of questions if you or someone can help me.

                    Question 1 : Will they able to expedit the AP process through phone? do you know if they approve, how we come to know?

                    Question 2 : If she travels will that hold the AOS process?

                      1. You start the request by calling. You have to be transferred to a Level 2 officer. It's best to call in the mornings. You'll have a better chance of talking to one then. Even if you do not have the documentation/evidence yet, you should still call and find out what steps they want you to follow.

                      2. No, EAD/AP and I-485/I-130 run on different "production lines". You've probably noticed how some people get their interviews before getting their EAD and then shortly after, their EAD arrives. The biometrics must have been completed and reviewed in order for the AP to expedited and processed. This will not expedite the EAD. In this case, your spouse will get an Advance Parole document.

                      3. You can use two google extensions - Visual Ping & Super Auto Refresh - to help you secure an infopass appointment. Google the following in quotation marks "How to get an appointment on infopass". It will be the first result. It's a thread from another site. It explains how to use the google extensions. It's all about refreshing constantly.

                        I am really sorry to hear that your family in such a difficult time. I 100% support you and your wife to go see your mother-in-law in such a difficult time.
                        I was in a similar situation. I have gotten a call that my mom is ECU and was ready to leave everything and fly out of the country. You definitely need a medical document from the doctor stating urgency and difficulty of the situation.
                        We have received that document in the form of a colored scan. Then we went to the accredited agency to translate it to English and certified by that agency.

                        There are 2 ways to expedite EAD/AP as far as I know:
                        1) make an info pass as soon as possible. Go there with all documents including your wife's birth certificate and that note from the doctor. If you have purchased the tickets, take them too. We did not go this way, because our office was 10 hours drive and no way to get infopass so close to the current day. It depends on your office. So we tried another way.

                        2) call congressmen and explain everything. Send him this documents via email. It took us about 2-3 weeks to receive a combo card, but thanks God my mother was out of the emergency care unit in a few days. I was thinking this process would take less, so looking back I would've research more the first way....
