  • Bloody RFE!

    Grrr! I got excited when the uscis.dhs site sent an email saying an action had been taken (the main uscis site doesnt say anything). I thought it might be my work permit that ive been waiting for.

    NOPE!! An RFE. On my I485. 170 days after filing!!! I wasnt expecting that. Even the woman at infopass and one of the agents on the phone said that if I was going to get one I would have had one ages ago and that my file seemed ok.

    I guess now I have to wait for it to arrive to see what more info they want. Guess I can stop hoping for my permit to arrive any time soon!

    whats your field office? I understand your frustration this waiting around is awful!! did you do a concurrent filling?

      Local office is Las Vegas but as far as I know my cases are still sat at NBC. Yes, we filed concurrently with a PD of October 23rd 2017 although only filed for work permit and AP in December.

        Im sorry you got an RFE, hopefully will be something simple to resolve, if you filled for EAD in December you have chances of hearing something about it soon!! This waiting sucks big time!

        Have you checked processing times of your local office? maybe they are backlogged

          Local office is 11-18 months for green card.

          Still haven't received the RFE; I'm considering calling them to ask so I can get my response prepared but need hubby home so he can give his consent to discuss it with me.

          Does anyone know, will the RFE for the i485 put my EAD on hold or are they two different matters??

            Usually the letter would state that your case will be on hold until they receive the RFE response.

                    It arrived

                    So it says "the petitioner/sponsor lists their current income on form 1-864 as an amount to be considered as sufficient however no evodence has been submitted as proof of current income".

                    I sent W2/1099 for hubby along with bank evidence of payments for the last year into his account from Lyft who he work for.

                    In case it needed a household sponsor, his parents who were living with us signed to say they would aupport. I sent copies of their investment portfolio and their tax return. So im confused.

                    I will send it all again, although my in laws no longer live with us, my husbands income this year far exceeds the minimum so they aren't needed.

                    Im confused as to why they have sent this given that i sent all that in.

                    Would it be worth calling and asking specifically if they are referring to my husband or his parents and asking what proof they need in addition to what I already sent? I wonder if its an error?

                      I'm confused too. There is nothing wrong with asking questions so I'd call and ask.
