You need to talk to a lawyer. You either tell the whole story here or tell it to your lawyer. One thing for sure no one can give proper advice unless they know what the issues are.

I would not recommend re-filing until she is out of jail (prison ?, there is a difference), and court disposition is satisfied and you have document evidence of the disposition.
