  • EAD expedite request with job offer

    Hey guys,

    I just received an RFE for my I-465 so it will delay even more my application which was in October. I studied business in College. However, I am being offered a position as a tennis instructor in a country club where I live. Would I be able to use that job letter to expedite my EAD? or is it not recommended?
    Oct 25th - Package Delivered
    Nov 3rd - Checks Cashed
    Nov 5th - Received text and emails for all three cases
    Nov 10th - Receive Letters (Priority Date October 26th)
    Nov 16th - Received Biometrics Appointment
    Nov 29th - Biometrics completed (No case tracker updates)
    Feb 12th - service request
    Mar 25th - Still working on tour case nothing to be updated message
    Apr 11th - RFE letter
    Apr 25th - RFE delivered to USCIS
    May 24th - EAD acceptance email
    June 1st - EAD delivered

    I hope the RFE is simple. All you applications are in hold until USCIS receive the response.
    I think that your EAD will be approved in 1-2 weeks after USCIS receive the response.

      Our timelines are almost identical. I also got a RFE this week; its late in the day to be getting one but at least it means someone is looking at our cases. I'm hopeful that the EAD will come shortly after sending the information back.

        Good to hear I am not alone. Have you received your RFE on the mail yet? I am eager to know what is that they are asking for.

          If it is work based I-485 it is likely to be J supplement.

            Mine is family based. Married to USC.

              I meant I got one for my I485. My application is family based. The RFE said that the petitioner/sponsors income is enough but that I hadnt included evidence. Except I did include lots of evidence including W2/1099, bank statements showing payments from his employer, and just in case, his parents who were staying with us signed to say they would support and included a copy of their tax return and their investment portfolio. I'm waiting to speak to them on Monday about why theyre saying we didn't include any evidence and what specifically they want me to send this time that they haven't already had.

                Two questions for you:
                - Your husband is your petitioner/sponsor. Did you include his federal tax returns? You did not list those among the items you sent.
                - Did his parents also signed an affidavit of support?

                If your husband's income is enough, then you don't need a joint sponsor's income + assets. That adds a layer of complexity to the form. There's more room for errors. Even though, your husband's income is enough, they still have to review everything else you sent.

                You mentioned your timeline is similar to OP's. Therefore, you must have filed sometime in October 2017.
                They may be asking for evidence of the income you entered under "current income"; i.e., his paystubs. His bank statements aren't enough. Those show a payroll deposit, of course. But they want to see paystubs. By now, they probably want to see paystubs from 2018. You can usually access those online. They include a breakdown of taxes that are deducted, health insurance premiums, life insurance - all of that. Thus, W2s are not evidence of his current income. They're evidence of his 2016 income.

                While you have the Level 2 officer on the phone, you can ask if they also need your (joint) 2017 federal tax return.

                  I sent whatever form it was that was given on tje instructions. He works for lyft so does not get pay stubs. He gets a deposit into his account each week. The proof of income is literally the deposit verifications each week and then the 1099 at the end of the year. His earnings for this year far exceed the minimum so we do not need an additional sponsor thank goodness.

                    My RFE is also for I-485. I have not received the letter in the mail yet so I am not certain what they are requesting. Good to know you can make good money on Lyft though lol. I may apply when I get my EAD to make some extra money.

                      He does make good money but he also works long hours to get it. I'm lucky to have a husband who isn't afraid to work hard. Unfortunately it means I don't get to spend as much time with him as I'd like. Still, once I'm working he wont need to work so hard.

                        I just checked and it was the 1040 US individual income tax return that I sent. We aren't able to file jointly until i get a SSN was my understanding?

                        He is self employed so no deductions at source.

                          I received my RFE. They are requesting a copy of the latest Federal Tax return for my joint sponsor. I filed in October and I submit the 2016 W-2 form and paystubs. So, either they opened my case late and want the 2017 return now. Or, instead of the w-2, they actually want a copy of the 1040. I got an info pass for the morning to clear that out.

                              Yes, you either send federal income tax return form + W2s + 1099 OR IRS transcripts. You can't send W2s and/or pay stubs as proof of income for the latest tax year. At the time you filed, that was 2016.
