  • Virginia filler !!! I-485 / AOS March 2017

    Hello,

    It's been more the 12 months from filling I-485 and acceptance of fee and still not heard anything back from immigration. Can anyone advise the process timeline for AOS for Virginia.
    Local office is Norfolk, when i check on their site they show the process time for 27, August, 2016. is the timeline accurate ?
    On March 30, 2017, they accepted the fingerprint fee for Form I-485, Application to Register Permanent Residence or Adjust Status.
    After that i haven't heard anything about my case. my EAD and travel document I-130 would be soon needing a renewal too. any advised will be greatly appreciated.

    hi!
    looks like your office has a processing time of 6.5 to 20 months for family based applications. this is the source: https://egov.uscis.gov/processing-times/#mainContent

    i dont know if you are aware but they recently changed how the publish processing times for 4 forms included I-485, you can read more about it in this site: https://www.uscis.gov/news/news-rele...ocessing-times

    but as I understand this means 50% of the cases (no RFE, no errors) are processed in an average of 6.5 months while 93% of the cases are processed by the 20th month, the article explains this better , in theory you can not enter a service request until your case is over the high limit of the published processing time. Based on this information I would consider renewing the EAD, however this is only my opinion.

      Thank you or your feedback and will look into the link you posted and go ahead with renewal of EAD also the travel document which helps you to leave a country in process of your AOS/ I-485.
      does it surely get you in back. if you leave states to visit your home country for urgent issue ? because i have heard it's not 100% they let you inn even if you have I-131.

        You have pretty much be on an Interpol most-wanted list for them to have an issue with you returning from a quick trip abroad. Technically, once you get your EAD/AP, you've been cleared through several background checks. They add that clause because they have to. Otherwise, you would guarantee admission to anyone who gets EAD/AP.

          It does not look like you've had RFEs or any delays.Thus, you could very well infer that your case should be grouped with the 50% of cases that are processed within 6.5 months. Here is the data from your field office for the last 4 quarters.

          You don't have to get into super complicated math to see that this location has 3 times as many applications pending at the end of each quarter as applications received every quarter - throughout the quarter. It processes just about the same number of applications that it receives. But remember that they have to do it in order. So that 3:1 ratio kindda tells you that right now they're working on applications they received 2 quarters ago. And that corresponds with what they're quoting on the new processing times. 6.5 months for the median or 50%

          No higher level math. Just intuitively picturing the flow of applications, right? So that tells me that even though the case inquiry date says September 2016, you should ignore that and arm yourself with the data I just provided you and the data from the processing times and reach out to your Senator. Why is it taking so long? Where is your file? You need someone to shake the tree.

          Do not be afraid to do it. If there is a reason to hold you up, well they need to issue a RFE already. They can't just sit on it.
