RFE asks for 2 contradicting items - Customer Service said, get a lawyer

  • RFE asks for 2 contradicting items - Customer Service said, get a lawyer

    I really dont know how to deal with these people any more

    RFE for the second time regarding I-864 and my wifes income. Point one states, she has sufficient income but no evidence. (we will supply again). Point 2 states, she has insufficient income, please find a joint sponsor

    Customer service said theres nothing I can do about it, and maybe get a lawyer

    How can getting a lawyer help if they are not present when these people do not read what you send them?

    Venting, but letting people know how ridiculous this gets

    (My wife is a company CEO, there is clearly no way her income can be seen as insufficient, and we have supplied all the required eveidence twice)

    UGH that is SO frustrating and I 100% understand your frustration. I've also gotten an RFIE for I-865 (income) although my lawyer told me that "there is no way you'll get an RFIE" lol.... I pretty much resubmitted some documents and now my case is no longer on hold but of course, it delayed the entire process -.-

    I would save the money for the lawyer and just (yet again) resubmit some of the documents. Do you have your EAD yet?

    Date Received NOA Letters: 02/06/2018
    Received Biometrics Letter: 02/17/2018
    Biometrics Done: 02/26/2018
    RFIE (I485): 02/23/2018
    RFIE in mailbox: 3/3/2018
    RFIE received by USCIS: 3/8/2018
    USCIS update - EAD being produced and sent to me: 5/25
    EAD sent me to: 5/31
    I-485 "ready to schedule interview: 6/1
    EAD in hand: 6/4
    i485 interview notice has been sent in the mail: 6/4

      Can you still get EAD even if you get RFIE? I thought the process stops until you respong to the RFIE?

        Yes everything is in hold once you get RFE.

        Regarding your RFE:
        I think USCIS send general rfe when they find out that a document is missing. Therefore, in your case you need to provide evidence that your wife gets enough incomes through tax return or w2. If you are not able to provide this evidence it is not important how much your wife is doing. In this case you need to find a join sponsor.

        This is how I read the RFE you got.

          This has to have you up the wall. Well, let's fix it. Would you mind sharing the exact wording? Were you able to get through to a level 2 officer?

            Customer Service no longer arrange call-backs for Level 2. You have to call in and do the lottery, and they may or may not let you be transferred.

            There is absolutely no point in calling customer service, they read you scripted answers and are unable to tell you anything.

            I got my EAD after about 5 months. The original RFE was for exactly the same thing, which we responded too, and yes it put me back to processing day 1. Its a ridiculous system

            If goverments can read our emails and social media, can't they just check who we are and be done with it. That was a joke

              I got my EAD after about 5 months. The original RFE was for exactly the same thing, which we responded too, and yes it put me back to processing day 1. Its a ridiculous system

              If goverments can read our emails and social media, can't they just check who we are and be done with it. That was a joke

              Ugh great... my current EAD expires very soon but now that I am back to day 1 (aka March 8)... grr this will take a while now
