Rejected Application - Mailing Time?

Hi all,

I had my documents returned after there was an issue with the I-485 form when concurrently filing for AOS. I got advised it was rejected on 03/21, and when chasing a receipt number from a tier 2 officer they said I should allow 30 days for them to come back to me with the instructions to re-submit. It has been 35 days now, and I spoke with a tier 2 officer once again; they instructed me that I needed to email the lockbox email address to find out more information.

Has anyone else had any experience with rejected forms and the length of time to get them back for re-submission? Should I be concerned?

I haven't had a personal experience with it, but if it was rejected from the lockbox it means you haven't filed it correctly. USCIS's definition of a correct filing would be:

- Filed to the correct location
- Your package contains the correct filing fees
- Each form that requires a signature is correctly signed
- An immigrant visa is immediately available (i.e. when concurrently filing as immediate relative of USC)

The lockbox checks each of these criterion. If those criteria are met, they will cash the checks, process and send the receipts as well as forward your paperwork to the correct place for adjudication. If the criteria are not met, they will reject it and send the whole thing back for you to refile.

I suspect you should have received something from the lockbox team, which is why the level 2 officer is advising you of that. I hope someone can offer some insight from personal experience, but I wanted to outline the procedure above so that you can gauge an idea on why your application is being returned, while you wait for an explanation from them directly.

Thanks! I know it is because there was a part not signed. Baffling, as we checked those forms many times and i thought we had everything. I have been advised it is coming back to me with instructions on how to correct and re-submit. Once that is done we can send them back. Just seems very odd it is taking 35 days. I feel your pain, I re read my forms from start to finish many times before I sent it wondering if I'd missed something. Definition of madness, doing the same thing over and over again and expecting a different result, I suspect most of us going through this process could be classified as mad then :d

It is quite a long time, I think the average turn around for most rejected forms is 1-2 weeks. And I can imagine the waiting is unbearable, but as you say, government agencies aren't always noted for their speed.

I had something like this happened to me. They returned my entire application within 5 days of sending it to them & was told that I used an outdated version of the I-485. My wife & I checked all the forms & sent my entire application back with an enclosed letter saying that all the forms that I have used are updated & were taken from their official website. A week later, I got a notice that application was received & they cashed the checks.
Sometimes, they get overwhelmed with the amount of applications they receive everyday & make mistakes.

I feel your pain, I re read my forms from start to finish many times before I sent it wondering if I'd missed something. Definition of madness, doing the same thing over and over again and expecting a different result, I suspect most of us going through this process could be classified as mad then :d

When I was filing all the documents I was so nervous, especially the second before I closed the envelope. I remember though having a list of things to check before closing the envelope. I put in read SIGN THE FORM. It's a human mistake, it will slow down the process but in a long time you would be barely remember this mistake.
