  • Responding to RFE quick advice - provide brand new I-864 or not?

    Hi all

I had a very confusing RFE, stating my wife has sufficient earnings, but no evidence. The same letter then states she does not have sufficient earnings and to find a joint sponsor - customer service could not or would not help. No level 2 appointments or infopass available

We are providing almost all of the evidence requested that should with any common sense satisty the guidlelines.

My thought is, additionally, should we submit a brand new I-864 with the latest 2017 tax return on it - this shows her new salary as CEO, and cannot in anyway be insufficient.

Or will it confuse the already confused issue

Hmmm interesting. Would you please post exactly what it says or can you scan it and take a screenshot of it? (De-identify it please)

"sufficient earnings, but no evidence" - sounds like the income reported under "current income" is sufficient. Did she submit pay-stubs? Remember that current income is a projection of what she is expected to make in 2018. So you take whatever she's made so far and extrapolate it all the way to 12/31/18.

"she does not have sufficient earnings and to find a joint sponsor"- So is it that you did not submit evidence of current income? If there is no evidence, they be concluding that she does not have sufficient earnings.

It's probably easiest to fill out another one and make sure that it is 100% perfect. Include 2017 federal income taxes. Include transcripts if you can.

    All the best.
