Are K1 generally processed faster vs "Other Visa" applicants

    I kind of noticed that K1 applicants get processed faster than other visa applications adjusting from B2/F1 or any other visa category

    I follow Orlando office. The processing time posted is 10 months to 18 months.

    11.5 Months to 23 Months Employment-based adjustment applications June 18, 2016
    13 Months to 19.5 Months Family-based adjustment applications September 28, 2016

    While most of "Other" category visa application processed at least 13months (Based on recent data)

    K1 applicants are averaging 3 to 5 months to process or invted for interview..

    The last "other visa" person to have interview date had PD 2/2017 interviewed last 02/2018 while K1 applicants received interview notice with PD of Jan 2018

    Is this always the case? Priority given to K1?

    Not really, it depends on the case. I'm currently adjusting from B2 & I have an interview may month end. My process took 4 & a half months

      We debated whether to take the k-1, marriage AOS or K-3 route. (At the time, we did not realize the k-3 visa is obsolete.) I do my best not to look back. Here's why it may seem like k-1s are given priority or have a faster or smoother process. Remember that their burden of proof is to show US citizen and fiance have met within the past two years, have a genuine relationship and intend on getting married.

      Fiance has an interview at the embassy. Although US citizen petitioners attend frequently, that is not a requirement. You present evidence but it is not a mortgage or life insurance.Your evidence is likely a flight itinerary with both names on it, pictures of that trip, every text message you may have and well, ******** posts. When the visa is approved at the Embassy, all that's left to close the deal is walk to city hall and say your "I do's". Many report arriving to the interview and noticing that their application package had already been stamped "granted" or "not granted". So in a lot of cases, the decision really is made based on the evidence sent. So you see tables of contents that explain what the evidence means.

      It's a snowball effect from there. A lot of couples know what they're doing and prepare a solid package of evidence; i.e., within those 90 days they open bank accounts, get added as authorized users on credit cards, utility bills. Pictures, wedding, more pictures. Almost always the AOS interview is waived for k-1 adjustment cases. and the conditional green card arrives by mail.

      If they get called for interview, maybe the marriage took place and was registered but there isn't any evidence of bona fide marriage or commingling of finances. In other cases, maybe they got too close to the 90 day deadline and something weird happens. Say they got married on day 89 but filed the certificate on day 91. And laws vary by state. Bla bla, the ISO calls them up for interview. OR there isn't anything wrong and the case is picture perfect and because of that, it gets selected for training purposes or audit purposes. Then again, most k-1 AOS folks file a 20lb removal of conditions package I-751 and the interview is once again waived.

      I know it sounds like an awesome ride but until recently, the path to the 10 year green card was longer for k-1 visa folks. They were not eligible to adjust status if they divorced before the AOS was approved or before removal of conditions - which is pretty unfair.
