  • Concurrent I-485 and I-765 filing

    Greetings,

    I am filing an I-485 application together with I-765, based on an approved I-140 NIW.

    I was wondering whether I should include the same supporting documents with I-765 if I already included these in the I-485, which are both filed together.

    For instance, if I already included the I-797 with the I-485, do I need to add the same form with the I-765. Would it be enough to have it ion one part of the concurrent application or should I include it again?

    Basically, every form has, required supporting documents, make sure they both have those first regardless of multiple appearance, then further evidence you'll check on specification based on your case. At least that's what I did.

      I agree with this.

      You might see some people say that if you provide your birth certificate with one form, for example, then you don't need to supply it with another form because you're filing concurrently and they will have what they need. This is the wrong attitude.

      Each form specifically tells you what is required documentation to file along with that form, treat each form and supporting documents as if they were standalone. Remember that each different form could be separated at any time and then one of your forms is going to be without necessary documentation and you're going to get an RFE which will just delay your process.

      No matter how many multiples of each document, just do it. If each form wants a copy of your birth certificate, make that many copies and attach them to their corresponding forms. That way you are going to avoid possible delays and confusion.

        Like xnot mentioned, just submit them. The I-765 and I-131 get separated from all other applications right away and put on another conveyor belt -so to speak. So it's best to submit each application with its own supporting documentation.
