    Hey all, who has experience with issuing a drivers license in NJ while using NOA's as proof of status, with no prior EAD or SSN?
    I got rejected today even though website clearly states a possibility for noncitizens to apply for a drivers license

    It's a tough spot. Most states allow adjustment of status applicants to receive a drivers licence but the rules can vary dramatically by state. In the state I am in, Missouri, they require you to provide a valid I-797C Notice of Action indicating status, an SSN (or a letter from SSA regarding the status of your SSN if you don't have it yet but are waiting for it when your EAD arrives), a proof of address and your passport.

    If you haven't already, try calling your local DMV and speaking to someone who knows what they're talking about. Often these guys aren't fully aware of what an adjustment of status applicant is and can't offer the best advice. Or maybe someone from NJ can offer you some more personalized advice from that state itself.

    Many people wait until they receive their EAD and then their SSN a week or 2 later and with that you will have no issues getting your licence, but I do understand the wait between filing your AOS and getting your EAD & SSN can be irritating.

    4-10: Sent to Chicago Lockbox
    4-12: Arrived in Chicago
    4-14: Picked up by USCIS
    4-19: Email & text notifications received
    4-23: I-797 Receipts received
    4-27: Biometrics notice received

        Looking at the documents needed for a New Jersey driver's license, assuming your I-94 is already expired, you have nothing that satisfies the "primary document" requirement until you get an EAD or your green card.

        This is my personal opinion and is not to be construed as legal advice.

          I was reading elsewhere on the forum and they said that they give a license on your i797c
          I will see the thread and link you to it

            It depends on the state law. For example in Texas, you can apply for DL when your AOS is in pending status but some other states do not allow up until receiving your EAD. I would still suggest you check with another DMV office. They have a system called SAVE where they check your immigration status, basically by using the system they can see your application status too.
            Marriage-based AOS - Concurrent filing.

            04/11- Four Email/Text notifications

            04/27- Biometrics appointment received.

              Can i provide my SSN? I have the same case here in California. My EAD expires on Jun 27, 18. I am working as an OPT program. My 485 is pending forever now. I?m still waiting for an interview. The department of motor vehicles says to renew my driver license i have to have a new authorication proves that I can stay here longer which is A NEW EAD or Greencard. Thank you.

                In NJ they require you to show an active ID either from your EAD or something similar. I showed them once in order to renew my DL my social security number and the letter saying my case was pending. Still they made me wait for my ead in order to renew my DL.

                  Hi I can truly understand the frustration you have now because I have been in that situation and mine was even worst, but Thank God and thanks to this forum so many people has the same issues and they shared it. And it is the same I am going to do now. I had this situation where I had to go get my biometrics done, and guess what, I had all of my documents expired including my passports which was the documents i had to use to identify myself. (when I came here in the USA I applied for a DL too but which of course expired when my I94 expire). After filling for my adjustment of status on marriage based, I received all the letters from immigration and now I had to go to the bio, when I got there the security told me he couldn't allow me to get it done due to my expired docs even though I had an expired DL from TX where I am, he refused and called the manager who came and took all my documents then came back with a letter which was a Notification of expired or insufficient identification. Now imagine me being in that position. I told myself that I was not going to let this go like this. I went back home and I started making some research online about people having the same issue and i came across which really help me. The next day I went straight to the DMV I got my DL renewed since I had already applied for it before, but yours will be new one. then that same day I walk in for my bio and it was done.

                  So now to answer your question go to the DMV with your NOA and the biometrics also and take the line for people who need a new DL. DO NOT USE YOUR PASSPORT at the DMV. I will tell you why. in your passport your I94 has already expired and no matter what you or how many time you go there it would not work. When you get there insist that they should use your ALIEN NUMBER . Most people at the DMV don't know it, and its true even the lady who did mine had to call the manager to come help her. Once the use that they will get immediately a notification on how to proceed with your case and will ask you to wait for about 7 to 10 days. No you don't have to wait because the notification will come to your mail in 7 or 10 days or even more. What YOU NEED TO DO AT THIS TIME is to track it your self by using SAVE there you will enter your ALIEN NUMBER DOB and name then it would give you the status of your case. If YOU read CASE RETURNED TO THE AGENCY don't even wait a second go back there to the same DMV and get your DL.
                  Now it varies from one state to another. they gave me ONE YEAR.

                  Finally I was able to extend my DL with pending h1b extension and pending adjustment of status. Would like to share few things I realized and had a quick conversation on this with the agent who really knew how to do/ what they can do on the systems, and what they really need.

                  As most of us have faced problem while pending h1b extension status. I basically read so much on the form taking the receipt 797 and so on, but one KEY POINT is, we need to see if those receipt has USCIS or ALIEN number. If it has ALIEN/ USCIS number, then tell the agent at dps to use ALIEN NUMBER rather than keep asking for I94. In their system they have both the options, and if you insist them using alien and if they do not agree then ask to talk to manager. Now most of us know about SAVE system, and we know they could send the documentation, but always remember they use ALIEN / USCIS number all the time. Do not even give them I94 as this is already expired and won't be updated until the approved letter.
                  Before you leave be sure they used Alien Number/ USCIS number. The agent showed me the screen they have ALIENT NUMBER as input box. Some of you might get extension right away or for some you need to wait on the SAVE verification. The agent will say wait for the letter. But what you can do is, go to this website : https://save.uscis.gov/CaseCheck/CaseCheck.aspx and choose the alien number and see if the case is pending or sent to requesting agency. Once the case if complete you do not need to wait for the letter to come which might take 3 weeks, but this case gets update in 3-6 days only. Just go with the same document, dl, . As a matter of fact they do not even need any thing. just give your DL, they will have the green signal in their system, and you get the license. For me I got a year.                       I would like to give some personal feedback about it because i tried as soon as i got my i797c
                      , i went to one of the DMV in miami and they denied me this with different innacurate answers so i went to another one that was 20 miles away and they accepted it. Soo... Dont give up on the first DMV office because it definitely depends on the courtesy of the oficcer and their senior officer.

                        It says "I-797 - approved petition". Truth is, it comes down to whoever you get at the DMV and who's up for flexing their federal-employee-wanna-be muscles.

                          We had the same experience today at the DMV in Eagan, MN. We got some DMV lady who wanted to play USCIS agent. She saw my spouse's passport and noticed the F-1 visa. Then, asked for the I-20. I jumped right in and said "That is no longer valid. We are adjusting status and here is the I-797 that shows the I-485 is pending." It's like I had just talked to a brick. So sure enough, looked at the I-20 and saw it expired a few months ago. Then, asked for the I-94 which shows D/S (duration of status). So I said to my spouse, well, show her your EAD.
                          The lady took the EAD and went with that. However, the stupid EAD IS NOT VALID, LADY. It became invalid because my spouse was unable to find a job in this land of the arian supremacy. So sure enough, I just checked SAVE and can't find the case. My spouse did not pass the road test. THAT'S another story.
                          I guess I do not understand what people are supposed to do. It sucks and that is why I will do whatever I have to do in order to get that interview appointment set ASAP; especially after our case got to the "Case is ready to be scheduled for interview" after 39 days.
