  • Multiple 485 Applications

Hi. I am a primary and my wife is a beneficiary on my EB2 application. We filed for 485 AOS when my dates became current in 2012. So both of us have a 485 pending. We got our EAD and AP also but never used it since we have been extending our individual H1B's every 3 years. Now my wife's EB3 is current and I am a beneficiary on my wife's EB3. My question is, will there be any problem if she applies a fresh 485 for both of us since her date is current now? Will we have 2 A#'s each? Do we have to tell USCIS and if yes how that we already have a pending 485 through my EB2? I don't want to miss a chance of getting GC through EB3 since my EB2 is taking such a long time and EB3 is current

I believe, yes, you can have multiple I-485s at the same time. You would each have only one A#.

This is my personal opinion and is not to be construed as legal advice.
