    Hello,

    I'm in the process of submitting my green card application by marriage to a USC while in the US. My case is superficially easy to handle because i overstayed my visitor's visa (due to unfortunate events) after many years of a clean traveling record since i was a child and i have decided to submit all the paperwork myself since i used to help people submit visa applications in my home country, besides the fact that i submitted my own visa applications since i turned 18 (now 32); However, this is where im in a standstill with what information i should fill out on Part 3, Employment History Section, should i be 100% truthful as to what i currently do for work (independent contractor), even though i am virtually not supposed to be working? Also, on part 8, General eligibility and admissibility, question 16 asks if i've ever worked in the US without a permit and if i've ever violated the conditions of my nonimmigrant status, which if they are referring to my current situation, it's a yes because i both overstayed my visa and am working, however i do not know if they refer to previously or if they are referring to right now at the moment i submitted the application??? I did have a consultation with two different immigration community centers, who stated that because i married ai USC, immigration forgives those faults but i don't know what i should do!! unfortunately we do't have the money to pay a professional to do it for us and that's why i am doing it myself but these forms are way more complex than your regular b2 visa application!!Any input will be greatly appreciated!!

    Yes, be 100% truthful. It can't hurt you. Hopefully you didn't work as an employee that required you to fill out an I-9, because then there would be questions as to what you put on there.

    Yes, say Yes to both, and just truthfully and factually state what periods of time you worked without authorization or went out of status. Again, neither of these things are relevant to AOS in your category.

      Excellent! I will then proceed with submission because i am being 100% truthful to my answers but wasn't sure if my truthfulness would be taken out of context nowadays. And no, i fill w-9 for taxes. Thanks

        Answer the questions with truthful responses. You can be accused of misrepresenting your history if you don't report employment in the U.S. But you won't be deported or fined if you do report employment without an Employment Authorization.
