  • I485 Interview and retrogression

Hi I have my green card interview next week. However I have been told that due to retrogression, even if all goes well in the interview I won't get green card before Oct 2018. However my current employer has been downsizing in the US hence what if I am let go after the green card interview. Can I still stay in the USA while waiting for my green card to come in October. Please advise?. I am currently on L1A and my visa stamp is valid till 2021.

Being let go doesn't technically affect the application, but usually when a company lets you go, they also withdraw your petition. If your I-485 has been pending for at least 180 days when they withdraw your petition, your petition doesn't get revoked, and you can continue to immigrate on it as long as you are employed in a similar job to the one you were petitioned on. You can work on L1 or H1b or EAD for that new job.

This is my personal opinion and is not to be construed as legal advice.

Thanks. So since I am on L1A , I would have 60 days to find a new employer who can hire me in my current visa status?
