  • My **** wife only married me for green card and I have proof

    Can I get an annulment?

    She has a temp green card. I want her to go back from this country as I do not want her to use me and benefit from my help.

    Once an annulment is complete she can no longer marry here right and stay here legally for 10 years as she's been illegally here for almost 2 years once the annulment is complete.

    To women and men here who are hating me for wanting her to back because I want an annulment and not a divorce because I know she only married for a green card, please don't post here. I know you guys will come in upset and hating because u want me to accept what she did as a fact of life and just divoece her so she can continue to remain here.

    No thanks. I want her to have no chance of staying so she can know what she did

      Yes. An annulment is better because on form i864 it says even if u divorce you are still responsible to take care of your spouse.

        Go for the annulment. If you have proof then it's a very good idea. Then her entire time here is going to be illegal as she gained a green card through fraudulent means. Simply divorcing can mean you still have ties to them, the annulment will just cancel off the marriage assuming you have the evidence it was never bona fide from her point of view.

          Not true. She can file for Removal of Conditions on her own on the basis that the marriage ended in annulment.

            You're right and wrong. She can try. But the usual requirement of jointly applying for removal of conditions is going to be hard to do. She could apply for a waiver, but she'd need to prove the marriage was bona fide from the start. This guy says he has proof that wasn't the case. Therefore she had no right to the benefit and therefore obtained it illegally and thus she can go no further.

            If you want to contradict advice, don't just provide information on what she can do, i.e. file for removal of conditions, but explain that it's tricky, especially if it was fraudulent from the start. I notice you do that a lot.
