  • Why Birth Certificate not registered earlier

    Hi,
    I am from India
There was a question in i 485 interview after submitting the birth certificate( which I applied and received after 30 years of my birth ).Question why was the birth not registered by my parents when I was born even thought they are educated and doing job.Normally after 1971 it needs to be registered but in my case it was never needed in any place until now and it was not officially registered in records (born in Home). Was mid wife was present at the time of birth. (I don't have answers for any of the questions)
They asked me to get back specifically.Parents are too old and I am trying to check for reasons. I dont know the reason
Normally this was never an issue for me until it was required for GC, which is when we applied. All my studies, etc didn't need it even for getting passport ,in India 10 grade certificate was used as birth proof as it was not mandatory to have birth certificate.

Again there was never an instance where birth certificate was a need for all my studies and we applied and got it after formal verification from Indian officials recently after checks.

Also is it mandatory after 1971 must to resister birth certificate and if not any other clause which can be used here.any suggestions or any attorney or experiences of yours earlier. Please help

I am checking with parents, to recollects as they are too old now.

Is this something to worry about

    Hi,

It is always better to have the birth certificate, in the interview notification mail which I got the USCIS clearly stated that they want to see my original Birth Certificate. Nowadays it?s easy to get a birth certificate from india as there are new websites from where you can apply or get a birth certificate. Google/search the particular website which can help you or you can physically apply for a birth certificate from the Municipal office close to your birth place.

I recommend you call the USCIS helpline and explain the situation, they will give you the best advice.

    Thanks!
