  • Is this normal

    Good day all,
    Marriage based
    Field office Houston Texas
My PD is July 13 2017
    Fingerprint was August 8 2017
RFE to submit I130A received a week a after biometrics
RFE was recieved by USCIS on August 18 2017
Recieved my EAD card on November 1 2017

Since then ive been waiting to be scheduled for interview and me and my wife just celebrated our marriage anniversary on April 4 this year making my marriage 2 years and my relationship with my wife 3 years.

    My questions are;
    - I've not even be scheduled for interview yet,is this normal cause my I485 says (Response To USCIS' Request For Evidence Was Received on August 18)
    - My I-130 says (Case Was Received)

Am just worried that ive not been scheduled yet.

And finally is it okay for me to start application for a new EAD card from July considering that my current EAD expires on October 29th?

Did you call them? I know Houston is really slow due to last year?s hurricane. And I think you are suppose to renew your EAD three moths before it expires. I could be mistaken.

Look on the bright side. Now when you get approved you will get a non conditional GC.

Houston has an average processing time of 15 months i.e. you will possibly to be schedule for an interview in 15 months from August (when they accept your RFE). November would be the month most likely you will have the interview.

I would go ahead and file the EAD renewal now. Mine took over 5 months to process, so by the time they actually look at yours it'll be in the 90 day window.

I would not categorize it as "normal". I would say, though, that it is expected. I dug out these two threads for you. It has Houston, TX filers with PDs as early as 10/2016 - maybe even earlier. I thought it might be good for you to check in with others who also have the Houston Field Office.
I feel your frustration. I have the Minneapolis Field Office and it's right next to Houston. They take turns being the slowest. Houston had a hurricane. The city drowned. I GET IT. BUT HERE? Nothing. We're just slow. No sense of urgency. 9 months of winter will do that to you. You walk too fast and you get frostbite.

            Here are the links

You can submit your EAD application within 180 days of expiration. IF it expires, you should know that applicants adjusting status under c(9) category (marriage based) get automatic employment authorization document (EAD) extension. Here is the link.

You would just show your employer your I-797 and this USCIS page. HR should know but it's possible they have no idea.

            All the best.

Are Canadians the majority of the applicants in Minnesota? Seriously I would have never EVER thought Minneapolis was the slowest office. EVER.

                    I-485 still pending

My PD is Nov 2016 and i still have not heard anything. My case status shows ?At this time Uscis cannot provide...? for more than 3 weeks. I called uscis and they told me that it?s a glitch system and my case i still pending. I dont know how long it will take. It really stresses me out since i am still waiting for my EAD for more than 5 months since the day that i filed a renewal.

I would have to say that it is not normal for at least half of the field offices. What is your field office?

                        What about driver license

My question is about the driver license since the expiration date is the same as the work permit they give you while the process the I-485.

My wife and I filed for Marriage AOS November 14, 2016 and we still haven't heard anything, in fact we have come to believe it will be years. We renewed the EAD once and will every 7 months so it never expires.
