    hi,
    I have been thinking of submitting my USCIS forms for adjusting my status for the past 1 month but I was thinking it is not going to work because my wife has been unable to provide her w2 for the past three years. please, what should we do?

    Best to consult lawyer. self filing is good for non complicated cases.

      If she submits the original 2017 tax transcript from the IRS then she doesn?t need to submit w2. She can give you that plus her pay stubs and employment verification letter from her employer stating how much she makes a year. That should suffice.

      I?m not a lawyer though but we submitted my husband?s tax transcripts without his 1099 or w2 and I haven?t gotten an RFE yet. Hope we don?t.

      It says on their USCIS website if you submit original tax trancript then no need for w2 or 1099

        You only need tax return for the MOST recent tax year. There is NO requirement for W2 or pay stubs. In marginal cases where your spouse barely makes enough to meet the poverty guidelines, it might help but again it is NOT a requirement.

          Thanks a lot for this answer, what if we have a sponsorer, did my wife still need to provide her tax return or not?

            Your wife, as the petitioner does still have to provide an I-864, even if you know she won't meet the requirement. Then you add a joint sponsor who meets or exceeds 125% of the Federal Poverty Guidelines, who fills in a separate I-864.
