  • Unable to update address on I130

    My wife and I are moving at the end of the month. I contacted my lawyer to let him know of the move, and he proceeded to file the change of address. My wife got letter at our current address saying they couldn?t update because lawyer wasn?t listed as her lawyer. My lawyer got a letter regarding I485 saying that my address was successfully changed but I didn?t receive the letter. He sent me a copy of it and it shows the new address and lists him as the lawyer. I asked the lawyer and he said everything was going to be fine.
    I have another issue, the letter he recived comes address with my second last name only. I hate my second last name and it doesn?t list my first last name, the one I use all the time. I?m really ticked off about that.

    Will there be any issues?

    Are you Hispanic, by chance? I was reading an interesting article recently that spoke about how Americans still have difficulty with the two last names concept, and oftentimes the first last name gets dropped, or moved to the position of 'middle name'. It has occasionally caused minor issues in legal proceedings (but not usually). I tried to find the article but couldn't. Anyway, what does the other paperwork say? If the forms and everything are correct, it shouldn't be an issue and both names should appear on official documents.

    Did the lawyer submit a G-28 listing both the I-130 and the I-485?

      Yes I?m Hispanic and I know, I?ve run through so many problems about it ranging from credit cards to traffic tickets. They usually put my first last name as my middle name, and it ticks me off so bad.

      The letter that my wife (USC) got says that a person posing as her attorney was trying to change the address. But that person wasn?t listed as her attorney on the paperwork. It was addressed on her name.

      The letter that my lawyer has is addressed to me but with my first and second last name only. It says that my address was changed and it shows the new address. All the other receipts and biometrics letter came with both of my last names.

      The lawyer said he submitted the G-28 forms with the packet. So far he has received at his office a copy of our receipts along with my EAD/AP combo card.

        I can definitely see your frustration! The concept of 2 last names, as opposed to a middle name and a last name is very different to Americans, and also where I'm from, the UK. But saying that. you'd expect an entity that deals with immigrants from all backgrounds to be somewhat familiar with how a particular country deals with names.

          I am not sure that I am following everything that is going on here. I do want to share two key pieces of information with you (and everyone):
          1. you can submit your AR-11 up to 30 days before you physically move; and as late as 10 days after your move.
          2. USPS will not forward government mail UNLESS you pay for Premium Forwarding Service. Here is the link https://www.usps.com/manage/forward.htm

          If you look through the G-28 form, you will see that you can only enter the information of either the petitioner or the applicant - not both. The attorney likely only filled out one G-28 form, listed you and not your spouse.
