Front loading other evidence with RFE response. Is it okay?

The only request on our RFE was to send the most recent tax return of my spouse(the petitioner). Though we have already sent 3 years tax Return of a sponsor, because my spouse income did not meet the requirement.

But we felt we should front load other evidences with this RFE request, because our lawyer did not attached any bona-fide marriage evidences, aside civil documents.
We see this as an opportunity to send in several evidences, we have them lay down in the table of content.
Kindly advise if this is okay.

I am sorry you were misinformed by your lawyer. It happens. If you look through the threads, there are plenty of people who did not send much initially and within days, were able to strategize and craft incredible tables of contents along with convincing evidence of bona fide marriage. It's all about evidence that ties into or with other evidence. I like receipts for that. They're alibis. We can get into that later today. (I have to head out soon)

Without an RFE, I would not even try. This is my personal non-legal opinion. You do have an RFE and can include additional things. It has to be perfect - error free - not confusing at all; so that whoever gets it in the mail room opens up your package and says "oh ok, this is the response to the RFE which asked for taxes. Here are the taxes. They just want me to add all this evidence to the I-130/I-485 that were already submitted".

It has to be even more clear than it would have been if you had sent it with your I-130. You will need a table of contents for the whole packet. Then another one just for the evidence. See below.

Then, next you will include the table of contents which should include a brief explanation of what each piece of evidence is proof of. Make it neat. Print in color. Use legal exhibit tab dividers.
They do not have to accept it BUT I personally would feel bad throwing away something that clearly looks like someone lost several days of sleep putting it together. You will have to track it down yourself, though. You may or may not be able to confirm whether the stack reached its destination.

Depending upon where you're supposed to mail your RFE response, this link may or may not be useful.

Most likely, this will work out but do not be crushed if it doesn't. Since luck is for fools. We leave nothing to chance. You will also make copies of everything you send, and will still bring it to the interview.

I have been active on several threads discussing how to put together a table of contents, posted mine and a really nice example that I found online - it's where I got the idea from. I did NOT invent the wheel.It was a gal from France who left nothing to chance or luck. Others took in the advice and came back with great stuff. Amazing ideas. There are so many ways to show your marriage is real. Thing is that because it's real we don't think of these things, but they're all over your home, your phone - everywhere.

Just a couple of things. When printing evidence off the internet, include headers and footers in printer settings. That way the URL and date printed will display.

If you wanted to, you could include a timeline of your relationship and list major events. You could arrange the pictures according to that timeline. That timeline will come in handy for the interview.

Make sure to add a date, location and names of people to every picture.

Great job on going the extra mile and getting the affidavits notarized. While sworn affidavits are accepted, ultimately there?s no notary public to certify that the person who signed is who they say they are.

I would turn on notifications on all services and accounts to be sent to that joint email account. Set your phone numbers to receive notifications as well. Those text messages are evidence, as well.

I like how you added evidence of cohabitation from many different sources. Lease. Communications with landlord, cancelled checks, certificate of rent paid.

We printed account settings from our Sam?s club online account.

By the way, if you two go to the gym together and your gym online account shows your visits. You can print that Too.

I think you have plenty. Make sure you arrange it in a way that whoever gets it, does not even have to take it apart and just put it together with the rest.

I personally think you?ve done the right thing by leaving nothing to chance. One never knows how an ISO might react to a file that contains only civil documents and no evidence of bona fide marriage. You may or may not walk into an ambush. There?s no way to predict that. But then, why Gamble?

I would send this with a signature requirement. At least you?ll have a name.
