  • Called uscis about my case, they said they were ready to make decision

    Hello everyone,
I am writing here because I have a concern. I am married to a US citizen. We have been married for almost 3 years now. We put in my application (I-485 and I-130) on Nov. 30th, 2017 On Dec. 12th, 2017 I had my fingerprints done and on Dec. 26th,2017 I received a RFE because we forgot to put in our (I-864). So we sent it and also all of our taxes we had done together since 2015. Well I never heard back from USCIS to notify me if they received my RFE. So I called and put in a SR, and nothing. So I put another SR and once again nothing. I was getting worried that my RFE had gotten lost in the mail or that it was never received. So I called USCIS and got transferred to second level so I could speak to an officer, which I did. The officer was SUPER helpful. As I was explaining to him my situation, he said he couldn't see where my RFE was received but he would see where my case was ready to get a decision. This was April 25th, 2018 and he said my case was moved to "ready to make decision on April 18th, 2018. He also said that if my RFE was not received, my case would not have been moved to "ready to make decision". So my concern is: I did not have an interview, my online has not changed to "ready to make decision", and how long will it take to get a decision made on my case.

Unfortunately that really depends on the officer handling your case and how backed up they are. it will take time depending on your location and home country it can take 12-15 months minimum. but I'd recommend giving them a call again if you haven't heard anything by maybe august just to get an idea of where your application is standing status wise. I wish you the best of luck and wishes.
This is strictly an opinion and should not be misconstrued as legal advice. The use of this information is strictly at your own risk.

That is very odd. The only immediate relative interviews that are not waived are Spouse of US citizen. While you have been married for almost 3 years, I would expect to still have to go through the motions. I would give them a call today again before the day ends. There are Level 2s who have been there longer than others. I got one recently who wasn't much help. Call and see if you get the same answer.

And if you get the same answer, I would suggest that you ask how they can reach a decision without an interview. All the best.
