i485 Denied (HELP ME PLEASE!!!!)

  • i485 Denied (HELP ME PLEASE!!!!)

    Hi guys, my name is Gabriel, I applied for my green card on October 2017 in a family based application
    My wife is american and I am Brazilian.
    I got here in 2015 on the visa B1/B2 (And i wasn't planning, but i met my wife and we got married.)


    On 27 of October, I've sent all the application forms + all supportive documents

    And two months later, they sent me a RFE asking for another joint sponsor because my wife doesn't make enough money to be my sponsor.
    I've sent the new Joint sponsor form + all taxes forms and everything.

    EVEN though my new joint sponsor makes more than enough to be my sponsor, they denied my i485

    They said "After reviewing evidence, USCIS has concluded that you are not eligible to adjust status because you failed to submit:

    *Joint sponsor Adi* ** * * nascimento's Federal income Tax return or Form 4868, Application for Automatic Extension of Time to File U.S. Individual Tax Return, for the most recent tax Year."


    But the funny part is... I did. I Promise you that we Did filled everything that was needed .


    I don't know what to do, my wife is really sad and i am sad too.

    Please if somebody knows how to help, help me!

    Consult a lawyer.

      Get a lawyer. File a motion to reopen. If the refuse to reopen then file i-485 again.

        Take a deep breath. USCIS letters can be confusing. Would you be able to scan it, take a screenshot of it, de-identify it of course, and post it? It's not clear if they're giving you the opportunity to submit those documents. It is also not clear whether that is a Notice of Intent to Deny or flat out a denial.

        What is your timeline?
        When did your I-94 expire? When did you marry your spouse? When did you file for AOS? Did you get an approval on your I-130? Did you already attend the interview?

        A denied I-485 means you may not be able to remain in the US while you wait for your green card. There's more than that but in essence, that's a big part of it. So in that case, people have to proceed with consular processing IF they're of course, eligible for a green card.

        I don't understand this part "*Joint sponsor Adi* ** * * nascimento's" something birth?

        Are you sure that your joint sponsor actually filed taxes? It sounds like USCIS is saying he/she didn't and in that case, he/she would have had to submit form 4688 but that's nowhere to be found. Is it possible that your joint sponsor gave you a federal income tax return that he/she did not actually submit to the IRS?

        At this stage though, you must seek legal representation. This can snowball and go South fast.
