Yes, No, Yes and Yes
Originally posted by ENAM View PostHi, I am in the same boat and my EAD/AP expires in January 2019. Should I file now for a renewal, in this month of August? And do I need to pay or just attach a copy of the approved notices of EAD/AP and a copy I-797 of l-485. Thanks for your reply.
Yes you may file your EAD renewal in August 2018 ahead of its expiration date. No you will not pay another fee if your category is for example a C9. This may apply to other categories too. Yes send along copies if all receipts such as the ones you mentioned, copy of the existing EAD, 2passport size photos. Please read USCIS website for more detailed information on doing an EAD renewal.

Where you send the package is based on your state and category
Originally posted by ENAM View PostCan you please give the address where I should send the package? Excuse me I know I am disturbing you guys.
Thank you
Thank you for responding. The USCIS instruction will indicate the lockbox or mail that is specific to your state and the category that you filed. Since that was not stated, I cannot assist. However you may use these links. I hope they help.
All the best.
Certain aliens noncitizens who are in the United States may file Form I-765, Application for Employment Authorization, to request employment authorization and an Employment Authorization Document (EAD). Other aliens noncitizens whose immigration status authorizes them to work in the United States without restrictions may also use Form I-765 to apply to U.S. Citizenship and Immigration Services (USCIS) for an EAD that shows such authorization.

1. First, you need to place the request to expedite based on:
a. interruption of employment (letter from employer)
b. severe financial hardship (Bank statements with depleting funds)
c. USCIS error - application was erroneously rejected which delayed processing. (Show the letter of rejection)
Requesting to expedite typically involves speaking to a Tier 2 customer service rep. They will likely tell you to expect a letter asking you for evidence which includes a fax number. Gently nip that Waltz in the bud. You don't need to wait for the letter. The fact that they sometimes choose to mail the letter instead of emailing is irritating. Just ask for the fax number and an alternate fax number. You should also ask for the address to mail it, too. The fax machine does not always work. -I wish I were kidding.
As soon as you place the request to expedite, you will see on your egov account a confirmation number for the request. It will say something like "Your request to expedite WKD123456789MSC has not been assigned to an officer for response".
Insist that this is very urgent and ALSO insist they place the request for both the I-765 (EAD) & I-131 (AP). You will only provide evidence for the EAD but they really should be approving combo cards. It's the whole point of the combo card. Insist on getting a confirmation number for each request to expedite. In other words, you will walk away from the call with 2 confirmation numbers. That way when your request is approved.
2. Just a letter on company letterhead that confirms you are employed there, since when and needs to state your EAD expires on 08-15-18, and that proof of employment authorization is needed by then for you to continue working. Do not overthink it. It does not have to be anything fancy. Just facts. Your boss may not even be aware that your EAD will expire soon. So maybe inform your boss of the situation and still inform HR. The letter should include a contact person in case USCIS wants to verify the info. However, if you just send them all your paystubs, they will be less likely to waste precious time verifying the info. Paystubs will corroborate that you have been working there.
3. Link to find senator https://www.senate.gov/senators/contact
You want to reach out to someone who is pro-immigration and a democrat. In your case, it would be OK to reach out to a republican who is pro legal immigration. The rationale behind that - Your F1 status is still valid. And you want to play by the rules.
Your letter should be addressed To The Honorable Senator Joseph Smith. You should close it with "very respectfully".
You will share that you placed a request to expedite your I-765/I-131, mention the reasons and the evidence provided for each reason. Ask them to please inquire on your behalf and help you expedite. Technically, Senators do not have a say on whether the request gets approved or not. It DOES help to have a senator inquire. Someone will physically pull your application and examine it. It will be worked on.
You have to fill out a privacy act release form. The Senator may have a form that is specific to immigration. I would call the Senator's office and ask for the immigration caseworker's email. Briefly tell them the nature of the request and send it. I would cc myself to make sure the email went out. Call to make sure they got it.
I'm still waiting for my employer to give me the letter so I can include it in my expedite document package.
I'm reading about Infopass right now, and I wonder if I should book an appointment to bring everything in person and have a chance to explain it myself?
Since my I-765 is still at the an early stage (like I haven't really waited for days like other people) I'm getting worried that my expedite request won't be granted but I still want to give it a try...

Misinformation?
Hi all,
Thanks for starting this thread - really great input from everyone. Although people have made very valid points about the category not being the same when waiting for i-485 while on H1/F1/etc., I came across the link below which refutes what is stated here. Since I'm a skeptic and am going through this myself (filed as a spouse of a USC, working currently on a valid H1 expiring 9/30), I am inclined to align with you guys but this confusion is nuts. Has anyone spoken to USCIS to get their interpretation? Is that even possible? I would be happy to if someone can tell me who to approach for the best answer.
Thanks
EDIT: I should have mentioned that I spoke to someone via USCIS's online chat function, and they pointed out to me that I am eligible for an automatic extension.

Originally posted by kne0 View PostIf I read this thread correctly, we're coming to a conclusion that if an F1/H1 files for 485, and their authorization expires *while waiting for 485* they are not eligible for automatic extension since the category of the expiring authorization is F1/H1, while the category of the renewal is (c)(9). That is different from what the link states in examples 6, 7 and 8. Am I misreading one of the two?
Thanks

At the risk of sounding repetitive - can anyone suggest a number to call to double check "from the horse's mouth" so to speak?

Edgar was a robot friend. You cannot see that seriously? Do you even read what you are typing? You think USCIS links you to a site other than their own.
Next, your link is from 2010, EAD auto renewals started in 2017. Also in your link it explains when one needs an EAD and when one is capable to get an EAD. There is nothing about renewals. Sally can get an EAD cause of the i130/i485 correct so can you thats all.

I still maintain that I am confused and will consult a lawyer.
Thanks for the discussion Cali!
